I-129F (K1) got lost or stuck? Long processing times

Deeply concerned about how things are going with our application processing timeline.

 

Received NOA1 in October 2022 (K1). Now I see that cases that were filed in December 2022-January 2023 are getting approved without any expedition requests (beneficiaries the same nationality as me), while our case is moving very slowly in the queue. Using a case tracker app.

 

I don't understand how this whole system works but it seems a bit unfair. Or could it mean that our case somehow got lost or stuck?

 

Please advise me if there's anything I can do about this whole situation at the moment.

Unfortunately the USCIS considers your petition still in normal processing and you have to wait until May 2024 before you can inquire

What are these processing times based on?

 

If 18 months is a normal processing time then why are most of the cases getting approved within 12 months now?

A careful read of the USCIS website would indicate...

 

"The processing time displayed on the USCIS website is the amount of time it took us to complete 80% of adjudicated cases over the last six months. Processing time is defined as the number of days (or months) that have elapsed between the date USCIS received an application, petition, or request and the date USCIS completed the application, petition, or request (that is, approved or denied it) in a given six-month period."

 

and before you ask the next question, these times are updated monthly.

You can write a letter to your congressman

It will make little difference when the petition is within the published processing times.

Being the same nationality as you isn't the only factor though. Were they all done at the same case service centre as yours? You haven't completed your VJ timeline so not sure which one your case is at, but you can see processing times here - https://egov.uscis.gov/processing-times/

Its I-129f. Theyre all processed at the California service center, with the exception of AWA criminal cases which are processed elsewhere and take significantly more time. 

 

Unless OP was transferred to Vermont, it's just the luck of the draw.

Oh ok. Odd then that the processing times tool gives different times for each of the service centres.

 

But either way there's still a lot more to it than just being from the same country, every application will be processed in order but they're not linear, as each takes a different amount of time due to numerous factors.

if Processing time is shown to be 16 months, for a Jan 2023 NOA1 i should be able to submit an inquiry in April 2024. But why is my "Allowed inquiry" date August 2024...... 20 months from my NOA1?

It is because they said so, or maybe because the indicated processing time only means that is how long it has been taking to adjudicate 80% of cases.  One can only assume the additional time is to get them closer to 100%.

when you can submit an inquiry is based on when 93% have been adjudicated, 80% is just the average they give but 93% seems to be what they consider 'normal'.

their numbers are also based on last 6months, not 'current'. 6months ago it as about 14months to hear back but that includes RFEs. USCIS doesn't count RFEs, only approval/denial and RFEs can take anywhere for a few weeks to a few months dragging out the processing time ave for 80/93%

We finally received NOA2 after contacting the USCIS via the Senator's office.
