I applied for and was given approval to marry my fiance via the K-1 application process. I was able to qualify from the 125% poverty guidelines because I was working. However, in January I was given the opportunity to go back to school full time in an accelerated nursing program. I live off of school loans and the GI bill which is much more than the poverty level guidelines. Will this be acceptable for the affidavit of support in my change of status for my fiance? Or will I have to have a co-sponsor. Will this affect eligibility for medicaid if we want to have children while I am in graduate school?

I know that student loans *can't* be used for the AOS. As for GI bill benefits, I'm not sure.

I hope you won't be able to get Medicaid should you have a child. If you can't afford a child, wait until you can. Once you get your nursing degee and a job, you will have insurance to cover pre-natal and maternity care expenses as well as insurance for your child and husband.

It is not the governements's responsibiity to pay for you to have a baby. You are getting an educations, is that not enough?

The government is not giving me an eduction. I am taking out loans and using my investments which is what a GI Bill is. It was not free!

You have no right to judge her or anyone! holmjare im sorry for how rude she was too you dont worry what others do or say. You know the right answers and whats happening. I don't think this response was appropriate. First of all, from all the taxes we pay into our govt YES the responsibility of healthcare and education should fall on them. Most average ppl can't afford to pay their medical bills even with insurance since medical insurance is a big business like the medical field and pretty much sucks! She did not ask your opinion on the ethics of medicaid and it's really none of your business who pays whose medical bills for what reason. If you don't know the answer to the question posted then don't reply. Keep your personal opinions to yourself.

As for the question posted... I have heard on another immigration forum that pregnancy medicaid is not one of the benifits that is not allowed due to sponsorship of an immigrant or being sponsored as an immigrant but I don't know if you would qualify for it with your GI income since you stated that is above the 125% level.

I think that if you serve this country your medical care should be provided for - through Medicaid or whatever. I think that for military or ex-military people the immigration guidelines are different and I think it's only 100% of the poverty line not 125%.

From what I understand that's only if they're on active duty.

I'm not sure where you're from, but we actually don't pay very high taxes here. In socialist countries like Denmark taxes are very high compared to here, and yes, in those countries people get free medical care - many times after a very long wait. Simple procedures we get done here quickly take forever in socialist countries where you have to get on a waiting list. I had a friend in Canada that had to wait forever for simple dental work. Morocco has free medical care, but the quality is extremely low. You get what you pay for.

Both systems have their goods and bads, however; ours isn't socialist, even if it does have some socialist elements, such as Medicaid. In exchange for lower taxes, and less government benefits, we get the opportunity to choose what we want to do for a living and get somewhere if we're willing to work hard. I know not everybody gets the same opportunities, but at least we have them!

Obviously holmjar was in or will be going into the military and was willing to take the risk of having to go to war to obtain GI Bill benefits. I would think that it would be a shame if the law didn't count the benefits as enough income to sponsor a spouse, but then again, not all of our laws make sense, especially immigration laws.
