I-864 Change of address

I am realizing the i864 we submitted when submitting the I-130 has our old address (2021). I did not realize we had use our old address. We moved within the same state a few months after. My husband now has his interview set for this upcoming December. Will this be an issue? How can I correct it or is this something that needs to be mention at the first interview? Same for the job, I am the petitioner and I switched jobs after submitting the i864. Will there be a problem or what do i need to take?

You as the sponsor would need use I-865 to submit a change of address, that's supposed to be done within 30 days of moving. Your husband as the beneficiary would use AR-11 or online - this is supposed to be submitted within 10 days of moving. I doubt you'll have any issues, it's pretty common for people for forget to file address updates, especially sponsors. It's typically more of a problem for you if you miss case updates, appointment requests or RFEs because you didn't get a notice in time or not at all - that can jeopardize an entire petition.

So since our case is at the Ciudad Juarez consulate, and his interview is next month, should I still go ahead and submit the i865?

As neither the visa nor the I864 are “active” at this point ..as  he is still waiting to be interviewed .. the address should be updated at the interview. This is not an uncommon situation as there are often many changes between the filing of forms c and the interview. To be safe, complete an updated I 864 and ensure the beneficiary carries it to the interview 

 

Advice given above is correct once the visa is issued and the  beneficiary enters the US and gains LPR status.
