AOS Form I-864

Hello all,

 

When it comes to Form I-864, income and taxes, my wife started a new job over a year ago, her federal taxes was less than what they require but her total annual income at her new job exceeds the amount needed to be a sponsor. She doesn’t have the tax forms for 2023, so what can we do to show them that she’s capable of sponsoring me? Also do they care more about your current income or your previous years from the taxes? We received an RFE so I want to make sure we don’t get another or possibly denied. Thanks

I would respond with a letter of employment listing the annual salary, and include the latest 3-6 months of payslips. And it wouldn't hurt to include the last 3-6 months of bank statements, and/or a bank reference letter. If the petitioner has not already done so, the last 3 years of tax return transcripts should be included. In my I-864, I put a little extra effort in by including my credit score statement that I got regularly from my bank.

You think an employment job offer letter with the hourly rate would suffice?

I would convert that into salary per year. This is what we did, my husband asked HR to take his average weekly earnings (he was paid hourly) and multiply that by 52 (number of weeks in a year).

 

We also added an employment verification letter and pay stubs for last 6 months. No RFEs.
