Some states allow you to use a valid EAD as proof of legal presence so check with your state to see if they do.

So states also accept NOA1 for AOS as proof of legal residence. Pennsylvania for example.

1-916-657-7445. try calling that number its dmv sacramento california's legal something. i got my extension thru them. it arrived in my mail within 3 days.

South Carolina also accepts the NOA1 for AOS if you also bring your marriage license, I-94 (expired or unexpired), passport, proof of residence, and SS card or letter.

I received my Georgia drivers license and it expires the second week of September, which is the date on my I-94. So, judging by what I read, come September I will no longer be able to drive. (I would have kept my Canadian license except I could not register my vehicle without a Georgia license.)

If there is a solution I would sure love to hear it.

Georgia will renew your Driver's License with the presentation of a valid EAD. If you haven't applied for one, I would certainly do so - you may be stuck unable to drive for a month or two until it is approved but it will probably be approved before the AOS.

Hi Marc,

Thanks for all the info. It looks like my wife will be the driver until I get my EAD.

:thumbs: Looks like you've got a few options there! I'm actually off to the VA DMV tomorrow or Monday to get a State ID card.

FYI for others in CA...the rules for valid I-94 and such also apply to ID Cards. I know because I tried to get my wife an ID Card and all I got was grief because her I-94 did not have 60 days left on it. The girl said it can't be done as the computer will not accept it. The part that irked me was she then did some keying in her computer and said, "That will be $22 please." I thought she made it work and gave her the money. Then she handed me a receipt for application, which was basically a worthless piece of paper. All it had was her ID number on it and wording to the affect that this was only a receipt and not a verified identification. She told us we had to bring some other proof like the I-797 Approval for AOS and the would give her the real deal. Man, was I :ranting: !!!!! You think I could get my money back? Ummmm....Nope...the identification number was issued.
