Today I went to DMV CA together with my husband to take driving test. The DMV officer's took my Documents together with Form DL application's..after 15minutes he told me "Your I-94 is expired" ..I answered him "I've been here almost 5months, and still waiting for my I-485 Approval. Anyway, He told me to get a valid I-94 and Approval notice of I-485. Do I need to extend I-94 while waiting for my I-485 APPROVAL? if "yes" <br /><br /> <br /><br />Where do I get form I-94? <br />

Unfortunately the DMV is right. You will need your greencard before you can get a DL. Some states allow the use of the EAD so check the website for your state.

For example here in AL you need to show at least 180 days of legal entry to apply for one.

I dont think you can extend your I-94.

Well he was right because your I-94 is expired. You can't extend that one.

I do understand DMV point about I-485 APPROVAL NOTICE but bringing valid I-94 these never gonna have it unless I have to travel outside of US and go back on next day.. :lol:

I do understand DMV point about I-485 APPROVAL NOTICE but bringing valid I-94 these never gonna have it unless I have to travel outside of US and go back on next day.. :lol:

The CA DMV's rules clearly were not designed for people on K-1s. There are plenty of people who have I-94s that are valid for years however that would meet that requirement.

I received my Georgia drivers license and it expires the second week of September, which is the date on my I-94. So, judging by what I read, come September I will no longer be able to drive. (I would have kept my Canadian license except I could not register my vehicle without a Georgia license.)

If there is a solution I would sure love to hear it.

I would also be interested to see what other people's thoughts are on this one. I entered on a K-1 and filed for AOS/EAD about a month ago, my I-94 will expire on 9/11 (ominous date). I got my Virginia driving license this week, but in line with their rules it is only vaild until my legal presence in the US expires (eg 9/11 from I-94). I'm sure that the answer is hiding away in another forum topic, but I'm afraid I haven't found it - I guess the question is how are we technically legally present in the US once the I-94 expires. I have a NOA1 that confirms that I have applied for AOS, but I suspect that the DMV will not be too interested in that. All this has got me thinking that I don't know how I will be legally in the US after my I-94 expires, I am not entirely sure. I suspect that the USCIS recognises the NOA1 while the local DMV's do not. Let me know if you get any further on this.

I used my AP at Christmas time and, because the AP is valid for a year, so the new I-94 I filled in to get back into the country was valid for a year.

Was just as much a surprise to me as anyone else, but it makes sense if you think about it. Anyhoo, CA DMV accepted it and my license expires around Christmas time - unless the GC comes soon or they accept the EAD that was approved this week.

Thanks Misa - As luck would have it, it seems like Virginia does accept an 'Unexpired Employment Authorization Card (I-688A/I-688B, I-766).' as proof of legal residence:

So I may just have to concede that I can't drive on Virginia license from 9/11 until EAD card comes through (October if it takes the full 90 days). Having said that, I am able to drive on my UK license for up to 6 months in Virginia, so as I only got to the US in June it should be OK to fall back on my UK license during the gap. In reality that sounds a bit silly, but I guess the rules weren't set up with K-1 non-immigrants in mind :)

I think many of us has the say agony..... I went to DMV here in CA, and I was denied of getting a DL three times, mainly because my I-94 is less than 60 days (expiry is Sept 12) and the computer won't allow them to process my DL... and I thought its a good thing for me bcoz if they did process my DL, its expiry would be the same as my I-94 and it means that i need to re-apply for another DL w/c means paying again $27....I think what we can do is just to wait for the GC before we can get a DL that is valid for 5 years....

:thumbs: Looks like you've got a few options there! I'm actually off to the VA DMV tomorrow or Monday to get a State ID card.
