I Just Married a Venezuelan Woman in the USA - How to Proceed?

Hello all,

 

Could you please confirm the following steps are most appropriate for me and my wife? For context, she is Venezuelan, I'm American. We met in Mexico, dated there and then we moved to the USA on a 2-year I-134 Declaration of Financial Support visa in Jan 2023. We just got married yesterday in Tennessee. She already has her work permit here. 

 

Our goals are to 1) start the process of longer term residency and eventually naturalization and 2) get approval so that she can travel outside of the country ASAP.

 

Are the following steps accurately detailed? 

 

  1. Me - Complete and file I-130
  2. Her - Complete and file I-130A
  3. Her - Complete and file form I-485
  4. Me - Complete and file I-864 (I'm wondering if this is necessary because it looks like what we already did for the I-134)
  5. Her - Complete and file form I-131

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I assume she has HP good for 2 years and you mean the I 134a.

 

I 134a is not enforceable, you need to file the I 864 which is.

 

Fairly straightforward adjustment case, I would file for EAD as it is free and her current one expires with HP.

- Yes, I meant I-134A

- We already got her EAD

 

Can you advise whether there's a difference in processing times or potential issues when filing certain forms online vs sending them in via snail mail? For example, it looks like the I-130 and I-130a are available online while the I-485 and I-864 are not available online.

After seeing people mess up online filing I have a general preference for paper especially as you are going to have send some of it in anyway. Others may disagree.

 

Her current EAD is tied to her HP expiry, and it is free so apply for the adjustment one.
