I filed Feb 2023 and I was interviewed 5th sept 2023 .but I had an issue at hand now.the IO in charge of my case said they need more prove which I sent to them before the deadline but I was told by their recent noticed that I didn't respond to their request to submit the required documents for them to make decisions on my case .I need an advice on what to do.have anyone have the experience

Uscis Requested for more evidence from me before they can make a decision on my case.i sent the evidence with usps before the deadline but the evidence could not get to them so they made a decision base on my application and deny the case .what advice to follow the case up .they gave me 1mont to apply for appeal.pls I need advice if anyone has experience this situation

Why did they request evidence? What country are you from?

 

Doesn't USCIS give 3 months to respond? Why did it take you so long?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Your only choice would be to refile.   If the requested evidence wasn’t received by their deadline, an appeal will be futile, as it was not their error.

Am from Nigeria .why they requested for evidence is bcos I filed under 3years rule that's marriage so dey want to ascertain if I am living together with my wife

They gave me 1 months to respond to it.i have evidence that I sent the mail b4 the deadline.

And what evidence did you ultimately send in?

It does not matter when you sent it, what matters is when it was received.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

File a new N-400 application, and include more evidence of bona fide marriage, since the date of marriage til now, with the application.

When you sent it USPS , did you get Proof Of Delivery?,  such as signature, date-time received?

 

If they received it on time, you may be able to fight the denial.

Sent: 9/12/16: I-130 + I-485 + I-765 (USPS)

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Dey did not recieve the mail but from my tracking it said delivered to individual .the mail according to the denial notice I got from uscis said the requested initia evidence requested from me I did not send it and did not write them back to ask for more time to provide it .but I sent it on 20th Sept when the deadline was 8th October
