I tried to search both this site and the USCIS site for the actual numbers, but is there a table somewhere that specifically shows the income requirements to bring a spouse to the U.S.? I know its 125% of the poverty amount, but what is that number? Does it vary on geographical region of the U.S.A?

Sorry for the newbie question, but I am brand new here.

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

Now for a little more info and possibly ways to get around this:

I am a U.S. citizen. I moved to Canada to live with my husband in late 2005. The Canadian immigration was sent in 1.5 years ago and they haven't even started processing yet, so I am in the process of looking for a job in the U.S. I will move back to the U.S. and sponsor my husband for PR from there and we plan on living permanently in the U.S. Since Canada doesn't allow me to work while my application is pending, I had 0 income for 2006, 0 so far in 2007. I worked full time in 2005 and prior years in the U.S., so the income requirement seems to be my big issue at the moment. Any light someone can shed on this would be greatly appreciated.

hey there - i don't know where you are in the us or even if the requirement is different from state to state but i do know that in Pennsylvania it is $15,000 - they ask for bank/checking records and pay stubs etc. Not sure what your ways around it are - maybe get a relative to sponsor that part of it - i know many people here who have done that.

May 14, 2007 - Fly to Syria with my family to meet

May 18, 2007 - His entire family comes to my house to ask for my hand - I say YES!

June 15, 2007 - We get engaged in the church and have a reception for our families (it's the only "wedding" his family will see)

June 22, 2007 - I come back to the US

June 24-July 27,2008 - lots of research on VJ and work on gathering the papers needed...

July 31, 2007 - I-129F package received by VSC - YAY!!!! I was sooo excited getting the return receipt in the mail - on my way out to look for bridesmaids dresses :) Now all I need is a case number so I can track online - I'm so anxious!!!

August 13, 2007 - NOA1 - YAY!!!

JANUARY 8, 2008 - APPROVED!!!!

May 14, 2008 - he's finally here

June 22, 2008 - "Wedding Bells"

August 7 - Adjustment of Status and EAD sent

August 11 - Dates of both NOA1 for AOS and EAD

and we wait....

September 4, 2008 - Biometrics appt in Phila for both AOS and EAD

Joint sponsor may be your only option, and income requirement is $17112 for 2 people. This is gross income before taxes, not take home pay.

I have a question? In 2005 I only made $15,000. In 2006 I made $23,000. This year I should make $28,000. I have w-2 for 2005, handwritten 10-99 for 2006 and only check stubs for 2007. Also, I have never had a checking account, I'm still old-fashioned and keep my $ on me. Will I have a problem being a sponser for my wife or should i find a sponsor?

that should be enough... they care mostly about the recent year compared to two years past.. they really want to know if you are able to support her currently.. but if you are unsure, it will be better to get another sponsor as well :thumbs:

You will be fine.

Most Consulates treat the I-134 like a mini I-864 and request that you use the same financial evidence as the I-864.

Bank statements are only needed if you need to use the account balance as an asset if income is below 125% povertyline, Assets are only valued at 1/3 that of income. My income is well above 125% poverty line so I just put "ZERO" on the asset lines, and just listed income.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

No, I am good. I make plenty, according to the list for myself, husband, and 1 dependent child, when I am working that is. Now, I just need to find a job stateside and have my second telephone interview coming up in early next week. Do I need to file a 0 tax return for 2006 as I haven't filed anything in the U.S. ?
