I would suggest you ask your employer to upgrade your I-20 to H1-b (or another temp work permit, if you can get it earlier), then get married after you get the approval notice for it, followed by AOS.

Wow, ive never seen such negative comments to a simple, above board Question.

The UK citizen may not of wanted to say anything personal, may of just been looking for some advise, after all we are an advice forum are we not. Maybe he wanted a quick answer and did not want to go into the whole story but may of done later. :( Give people a chance to prove there in it for the wrong reasons before putting in comments like the above.

Ok..... yes you can fiile for a K1 whilst in the USA and then just go home for the medical and interview at the end of the process OR as you did not come into the USA with the intent to marry you could stay and apply for AOS. (im not saying do this or dont, theres mixed views. In the RIGHT circimstances it is legal to go this route)

Hope you find your answers soon and good luck on whatever you decide. :)

March 4th: APPROVED

March 17th: NVC posted file to London

JackJack actually answered the question--he came to study originally, and met a girl whom he liked.

However, many on VJ seem to be "boxed in" by the marriage-related visas--and never consider the work visa (as JackJack is on OPT, this is a viable option as I stated above).

Yes, he can go the work visa route to! I myself have never been "boxed in" i was just giving my view on marriage visas because thats what he was interested in. :) He actually states, he wants to marry a beautiful American girl.....Hence the marriage bit gave it away for me lol.

My apologies for casting aspersions. From your original post, it sounded like you were looking for someone in the US to marry. We get these kind here every now & then, and those people are why this process is so slow and so difficult.

Just follow Kezzie's link and file for AOS. You don't need to file for K-1 or K-3 and you don't need to go back to the UK.

Here is the situation: I am a guy wanting to marry a Beautiful USC, A girl I met a few months after I arrived, So yes, it is for love, (actually her birthday is next month which is when i shall propose, in some big romantic way :) After leaving my studies I was employed by a Diving company, (I trained as a commercial diver) and shall be with them for many years I hope. I will automatically apply through them for my visa form (whichever number it is) for continuing employment. Apologies for not making it clear before, but I work 12 hours a day seven days a week and I'm very tired. I'll try the guides, as indicated, but any further help would be great

By the sounds of this you would just apply for AOS since you didn't enter the usa with the intent of getting married. If you went k1 visa route you wouldn't have leave and could do it when you are there until you have your interview, but when you enter on it you can't work until you get your EAD and i think this would be a problem in your case since you already have a job in the usa. it can take 1 or 3 months to get the EAD.

Jeees sorry about the hard time you got!! We are lovely on VJ honestly and don't hesitate to ask us more questions :yes: !

That said the K1&k3 route isn't for you because you've got a job etc in the States and coming back to the UK to wait out a marriage visa is just stupid.........so you could just get married and just adjust status, you came to the US with no intent to marry (student, work visas etc) so I don't see why you would have any problems.

A few people on this site (jayjay is one I can think off) went on a tourist visa and got married and I think everything went ok for them! I went to the USCIS office in Fresno before I came home (was on J1 student visa) to ask about our options and the guy just said 'why don't you guys just get married now?'!

Anway check out the Adjustment of Status thread, i'm sure there'll be people you can talk to there.

Since you're in the US legally and you didn't go there just to get married, you don't NEED to apply for a marriage visa unless you have some deep-seated need to go back to England before you tie the knot. If you want to stay in the US and not leave you can just get married and apply to adjust status - you're not an illegal alien and there's no law against falling in love while you're going about your legal studies or legal employment... good luck!

It's perfectly legal and accepted to enter the US with the intent of getting married. It is intention to immigrate that can cause problems and is illegal.

Ok I said the same thing here as englishsammy "you could just get married and just adjust status, you came to the US with no intent to marry (student, work visas etc) so I don't see why you would have any problems." so why is what i posted getting centred out like i said something that wasn't right? how was I not right? he didn't originally get a visa with the intent to go there and marry someone. he met someone afterwards and as such could adjust staus with no problems. If he knew before getting a non spousal visa to the usa that he was going to marry a usc, but didn't go with that type of visa, is that not misrepresentation and considered illegal? your seriously confusing me. i feel as if i was misquoted, cause what you said didn't appy to the situation i was talking about. I'm really sorry if I'm completely out to lunch here. I'm not trying to be a b*tch.

All's cool :) not centering you out at all........englishsammy's post was after mine and I would of posted the same to that. It is not even misrepresentation to enter the US on a visitors visa or VWP with the intent to get married. Many of us have done that and returned home for the petitions to be filed and apply for a visa. It would only be misrepresentation and illegal if one was found to of had intent to immigrate if one applied to adjust status. So the last part of your post is correct. It just confuses members though when they read "with the intent of getting married" Not trying to be picky at all and I apologise if it came across that way.
