K1 Fiance Visa My Wife disappeared and is unresponsive. Found out from sister that she is having an affair with her co worker and intended just to stay with me until she she saved some money and then move out in an apartment with him. Also charged $10K me

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

she had a job so assume she had green card and u paid $1225 to AOS and filed out the I 864 meaning u r responsible for her if she applies for government benefits

and u should know where she works so she hasn't totally disappeared as a lawyer can serve divorce papers to her job / u need to stay away 

Credit card / i would take out a small loan to pay it off and then totally cancel it /  u may not charge anymore on it but if she has a card with her name she still can /  after paying off the balance ,  sue her in small claims court for the credit card debt.  California laws  Generally, you can only sue for up to $10,000 in small claims court 

When you close a credit card and you still owe a balance, the debt you owe doesn't go away. The card agreement still applies, and you are still legally responsible for repayment. The following will also go on as normal: You'll continue receiving credit card statements in the mail.Oct 24, 2023

 

Divorce ,  move on,  encourage her to work 10 years to gain 40 credit hours of work  or to naturalize ,  getting u off the hook for the I 864

GF???    not right away / get over this first

Did you authorize credit card charge?

Was your spouse's name on credit card account?

 

If you did not authorize this charge, you can dispute it by calling credit card issuer.

 

If she was an authorized user, had card in her name - you're equally liable for debt.

 

You should also be careful reporting unauthorized charge. If you have a fradulent claim (e.g. lie about unauthorized charge when in fact it was authorized by you), the consequences may be not so good.

 

In any case, you need to replace your credit cards your spouse had / has access to.

you can sue her for that amount in California in small claims court 

especially if it was for uneeded medical proceedures like cosmetic surgery and she used the card without discussing it with u

depending on  circumstances ,  u may be ordered to pay it all,  pay half and she pays other half or she has to assume all the debt

Not sure anyone here can say definitively.  Feel free though to contact ICE (You can contact ICE via email at Immigration.Reply@dhs.gov or you can telephone ICE at 1-866-347-2423. ) as they would make the ultimate decision, but I would not hold my breath.  I also agree with @Boiler, you need to discuss this with your divorce lawyer.

ICE might have its hands full, these days. A better bet is the FDNS Officer at your local USCIS office.   Present the information objectively, in full.  Frustratingly, you will never get an answer on what USCIS decides about it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
