Hello guys. What can I do about this? Is it possible for her to residency to be revoked and for her to return to Brazil?

K1 Fiance Visa - Married January 2022.

My Wife disappeared and is unresponsive. Found out from her sister that she is having an affair with her co worker and intended just to stay with me until she she saved some money and then move out in an apartment with him. Her sister sent me pictures showing this. She was trying to hide this from me. She was using my credit card to afford them while this was occurring. Including uber to get them both to work and back since he lost his license.

So her plan was to return, and save money until start of next year.

She also charged $10K medical bill on my credit card for eye surgery in the weeks prior and to this occurring.

Additionally she has been abusive to my 4 year old to 5 year old son where I had to separate them. I have this on video. Unfortunately don't have more because she started going around turning off the videos in my house.

Have you filed for AOS and has she received her GC yet? If it is still in the works, pull the affidavit of support now.

 

As for the abuse to your child file a police report with proof of it. Protect yourself and your son.

Seems like it is 22 months since her arrival and for most cases they would have filed to adjust an been approved by now, especially as so many interviews are waived.

 

Pull the I 864 if the case is outstanding, otherwise this is matter for a Divorce Lawyer not an Immigration Lawyer.

I don't recall this process. I think she does have her greencard but not sure

Yes she has her social security card and started working

Not only that, but he would have had to sign the I-864.  I don't understand how someone could not recall this process.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You're get her here with K1 and you not sure if she have a green card? Anyway, cut off all credit card, bank account, file for divorce and moved on.
