Hi everyone!

I'm in the process of completing my AOS package and I have a question about the I-864 that my husband is filling out. As for the supporting documents, would including the following be sufficient? :

  • 1040
  • W2's
  • 1099
  • Employment offer letter
  • Payslips from previous 3 months

Is the 1099 required? I wanna be sure we don't eventually get an RFE for forgetting something!

Also is it required to fill out both of our savings amounts (part 7) or is that unimportant in the grand scheme of things?

Skip assets.

He needs proof of USC or LPR

Why not use IRS transcripts?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I have his birth certificate so that's fine. Also isn't that what a 1040 is?

1040s will have to go with all his W2s.

IRS transcript is just solo

Wait what's the difference between an IRS transcript and a 1040? Are both necessary?

No, it's either:

- You get a tax return transcript from IRS (usually 1 page) OR

- You submit all pages of 1040 AND W2

The IRS Transcript proves income tax were not only prepared, but also received and reviewed by the IRS.  The 1040 is the return, but there's no proof it's actually been sent and received by the IRS.

A transcript is a receipt from IRS that proves you filed taxes and reported your income accordingly.

A tax return (1040) proves you filled out the tax forms but doesn't mean your income was confirmed nor that you even filed taxes as filling one out doesn't mean you filed.

FILING taxes is a requirement to be a sponsor.

The transcript is best.

As discussed, Transcript is best.

IF you dare to provide the Federal tax return copy, it can't be just the 1040 which is only a few pages and not complete. They need the whole thing. All pages and schedules and including all proof of earnings... so W2s for employed and 1099s for self employed.

  • 1099

As above, a 1099 is a earning statement for self employed. Are they?

  • Employment offer letter

Offer letter, no.

Current employment letter, yes.

And that projected income amounts listed on it is your current income for the I864.

Instructions state 6 months. Ensure you have read them.

See above.

Only if you are using assets because your income doesn't meet the FPGLs.

Does your income meet it?

Then don't use assets.

Wow thank you all so much for your information! This is so much clearer now - I'll get him to get the IRS transcript and payslips from the last 6 months.

I'm also still slightly confused about the W2 - is that what would be with the 1040? So is there no point including that since the transcript is best?

Yes, if you are providing the tax transcripts from the IRS you do not need to provide the 1040, W2s, or any other schedules.
