US embassy needs us to show them my 2006 tax return.

My case is like this, it is a K1 case. My mom is my co-sponsor, I just started working on 2006/7, and made so few money, so we filed 2006 tax return together, I was the dependent. My fiancée brought our family’s 2006 tax return to the visa officer, and she didn’t even look at it and want us to submit 2006 tax return of myself.

My question is this, is that possible that I can get a 2006 tax return of myself? If I have a co-sponsor, why they still need my information? They said on the blue sheet that “Verify pet’s employment beginning date and salary, On letterhead signed by official” What doest that meant? Right now I am self-employed, open-up my own travel agency. How do I get that?

"Pet's Employment" mean's you, the "Petitioner's" employment. If you are self employed then show your business license and bank account verification. Perhaps you also have a Federal Tax ID number for the business. Attach a statement indicating you were not required to file a tax return for 2006 because you had only X income and were claimed as a dependant on your sponsor/family member's tax return. If you can show evidence of income from your business, do so. Surely you have bank statements showing deposits to your business account.

Yes you can file a late return. Guangzhou is very particular about the I-134, you need to provide one with IRS return data, and current income, even if very low, they will accept a co-sponsor, but you still need to provide a separate one for your self. If you were self employed you can get transcripts from the IRS to include with the I-134, Transcripts are free, just order the simple transcripts. http://www.irs.gov/faqs/faq1-6.html

I wish you had found "A Candle for Love" way before the visa interview, I highly recommend that you join and ask questions there, the members know all about Guangzhou, and will give you the best advice, the FAQ pages are the most detailed for dealing with Guangzhou. http://candleforlove.com

Are you sure that you were not required to file a return of your own. The only circumstance for which this would be true is if you are right now 18 or just turned 19 and had only unearned income (interest, dividends) of less than $8500. I am assuming that you must be at least 18 now or you wouldn't be petitioning for a fiance.

IRS publication 929 says:

A parent of a child under age 18 may be able to elect to include the child's interest and dividend income on the parent's return.

It goes on to specify the limit of $8500 in unearned income among other conditions. To make this election, your parent(s) would have had to attach from 8814 to make the election.

You were required to file a return (unless you meet the situation discussed above) if:

(from Pub. 929, Table 1. 2006 Filing Requirements for Dependents:

You must file a return if any of the following apply.

* Your unearned income was over $850.

* Your earned income was over $5,150.

* Your gross income was more than the larger of: $850, or Your earned income (up to $4,850) plus $300.

Generally, if you are not required to file, you are not required to file. You could write a letter stating you were not required to file in 2006 (and that is why you have a co-sponsor). There are other people who did not have to file and just state so and can't provide a tax return. I don't know your circumstances, but I would think that you should not have included your income on your parent(s)' return. Circumstances allowing this would be rare. Did you get a tax professional to help you?

If you were required to file, you should file and submit copies of your late filing. If you were not required to file, but had income taxes withheld, you can still file though not required and submit those copies if you wish (instead of the statement that you weren't required to file.

You need to understand Guangzhou consulate, they can be very strict about what they want with regards to evidence for I-134, a person can file a zero return with the IRS.

Guangzhou is not Barbados.

I agree that the Guangzhou is tougher than Barbados. Still doesn't invalidate anything I said. I was busy typing my post when you put yours in, so mine was written without seeing yours. After submitting mine, I read yours and thought about adding via quick edit that even though the IRS might not require it, that they should do one anyway since the consulate requires it as you posted citing your familiarity with the process in China. I decided not to add this because I am pretty sure they have to file a separate return anyway because the IRS requires it (which takes precedence in the order of reasons to file a US tax return).

The OP mostly likely could not file on the parent(s) return because of age and the OP had earned income from what I gathered from the post, and was required to file a separate return according to the IRS.

My point is that even if the OP was going through Barbados, or didn't even have immigration concerns, I doubt that (s)he would be able to file with on the parents return.

Also, a person claimed as a dependent on another persons return cannot file a "zero return." Rules are different for dependents.

The problem is that I already filed with my mom as a dependent in year 2006, can I still get one for myself for 2006? How long will it take?

Not long just file it late (1040 and attach the copies of W2 and/or 1099) then submit a copy of the 1040 with W2 and/or 1099 along with a notarized I-134 to the consulate.

An accountant can bang one out for you in less than 30 min.
