:help: Hey guys!

My fiance' is a US citizen after birth. He was born outside the United States and he is a U.S. citizen through his parents, but he lost his certificate of citizenship years ago. HE can't file the I-129F because according to USCIS he should wait for his New Naturalization Certificate (which he requested 7mos ago!)

Question is... is his passport not valid as proof of his citizenship? can he already file the I-129F even without the certificate, just a passport? Our I-129F is on hold because of this. We are still waiting for his certificate replacement. USCIS site states that N-400 takes 6-9mos of processing. but thats for those who are applying for naturalization. my fiance is just asking for a COPY bec he lost the original. does anyone know why the copy is taking this long?

:crying:

Same case with me but I never got a certificate of citizenship. Passport is fine. Copy all the pages and include that with the filing.

It also asks for the number on the I-134 form used at the interview stage, I just contacted the embassy where my fiancee was to have her interview and they said that if I proved my citizenship with the petition, a copy of the biographical page of my passport was all I needed to show.

If your applying for a Certificate of Citizenship, the form is N-600 not N-400.

thank you for your reply... No my fiance' is not applying for N-600. He is applying for a replacement for his lost naturalization certificate (N-400) ... I will tell him about you just presenting your passport. Thanks again.

hmmm.. another thing.. the immigration mentioned that before "9/11", passport as proof of citizenship is ok. Now its not anymore, you should really present the original Certificate of Naturalization. is this true?

Did he gain his citizenship through his USC parents after being born abroad or did he gain citizenship through naturalization?

I was born outside of the US, but my mom was a citizen. Before I moved here, she registered my birth and the US embassy and I got my passport. Although the form asks for a certificate of citizenship, a copy of my passport was fine. But if your fiancee was indeed naturalized instead of getting citizenship through parents as you implied, then you may need the certificate.

You are both the same. he was born in the philippines and his father is a US citizen.. so it means that he does not need the certificate right? he was not naturalized. he gained his citizenship through his USC parent after being born abroad. a-ha! you are so nice... thanks again.

How Do I Replace My Certificate of Citizenship or Naturalization?

What is a Certificate of Citizenship?

It is a document issued by U.S. Citizenship and Immigration Service (USCIS) as proof of a person having obtained U.S. citizenship through derivation or acquisition at birth (when born outside of the United States). For example, your U.S. citizen parents were living in England when you were born. Or, your parent(s) became naturalized when you were under 18 years of age and met the special conditions of the law.

What is a Certificate of Naturalization?

It is a document issued by U.S. Citizenship and Immigration Service (USCIS) since October 1, 1991 and the Federal Courts or certain State Courts on or before September 30, 1991 as proof of a person obtaining U.S. citizenship through naturalization (a legal process to obtain a new nationality).

What Does the Law Say?

Section 341 of the Immigration and Nationality Act provides that, "A person who claims to have derived United States citizenship through … [various provisions of the INA] may apply … for a certificate of citizenship."

Section 338 of the Immigration and Nationality Act provides that, "A person admitted to citizenship in conformity with the provisions of this title [Title III] shall be entitled upon such admission to receive … a certificate of naturalization … ."

Section 343 of the Immigration and Nationality Act provides that, "If any certificate of naturalization or citizenship issued to any citizen … is lost, mutilated, or destroyed, the citizen … may make application … for a new certificate … ."

Who Should Apply for a Replacement Certificate?

You should apply for a replacement certificate if your current certificate is lost, mutilated, or destroyed. You may also apply for a new certificate if subsequent to issuance of your current certificate, your name has been legally changed either through court order or marriage or divorce.

How Do I Apply to Replace My Certificate?

Form N-565 is used to apply for a replacement certificate of citizenship or naturalization. It is filed in person or by mail with the local USCIS office having jurisdiction over your place of residence (Except if you live in Maryland; file with the Vermont Service Center). It must be filed with appropriate identification to establish your identity and the filing fee. Current photographs meeting USCIS photo specifications must also be submitted. (See instructions on the form.)

What If I am Outside of the United States?

If you are outside the United States you must submit your application to a USCIS office in the United States and be willing to return to the U.S. to pick up the certificate.

How Can I Find Out the Status of My Application?

To check the status of your application, please contact the USCIS office that receipted your application. You should be prepared to provide USCIS staff with specific information about your application, such as your Alien Registration Number, name, and date of birth. Please see instructions on checking the status of your application. More information on USCIS offices is available on our Field Offices home page. It is not possible to check the status of an application filed at a local USCIS office on-line at this time. However, you can check the status of cases filed at Service Centers.

If My Application is Denied How Can I Appeal?

If your application is denied, you will receive a letter that will tell you why the application was denied and advising you of how to appeal under the rules in 8 CFR 103.

Can Anyone Help Me?

If advice is needed, you may contact the USCIS Office near you for a list of organizations who can assist with the preparation and filing of your application. Please see USCIS field offices; then, see the About Us section for a listing of assistance or "pro bono" organizations.
