1-year ban for controlled substance

My fiancé had his K1 visa interview in Ciudad Juarez, Mexico on October 23rd. He was refused and given a 1-year ban for admitting to using marijuana during his medical exam. We are currently waiting on answers from our lawyer on what exactly happens now with the process. Right now all we know is that he can re-take the medical exam next October to prove that he no longer uses this controlled substance. If anyone has been through this, I would appreciate any insight into the process from here. 

 

If anyone needs comfort, I am here for you. My fiancé and I have been apart for 3 years going through this process and now we have another year added. I know how difficult it is emotionally, financially, etc.

Usually they want to see regular testing, is he in a program?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Might depend on how long ago the usage admission was.  I have seen stories where the initial medical showing no use, and another one a year later worked for someone that admitted to using several years earlier.  That being said, frequent check results might go a long way in the end.

He needs to take a drug test every 3 months to prove he is drug free. You will need to contact where he got his medical exam to do the drug tests otherwise they will direct you where to get them done. After one year of clean tests you will have to redo his medical exam.

Is khat illegal?
Yes, khat is illegal. Fresh khat leaves contain cathinone--a Schedule I drug under the Controlled Substances Act. Schedule I drugs, which include heroin and LSD, have a high potential for abuse and serve no legitimate medical purpose.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Any updates on this?  My fiance and I are going through the same thing for use of khat.  He was given a yellow (Pending) form at the Consulate.  The medical examiner called him for a drug test and another one a few months later at which time he spoke with a psychiatrist and admitted to occasional use of khat.  It has been a about 3 months since that - so about 6 months total from the first drug test.

He admitted to use of Ketamine?
