Is beneficiary's birth certificate required for K1 Visa?

Hi!

Is beneficiary's birth certificate required for K1 visa? I didn't see it necessary from USCIS website. Please anyone help to clarify. Also do I need to legalized/apostille the translated version of my BC? (my BC is not in English, so I guess i need to have it translated). Thank you so much!

It is required when you get to the interview stage :)

What country are you from? If you go to your country's US embassy website they should have a list of where to acquire original documents and where to officially translate them. My country didn't require a translation and yours might not too

Apostille isn't required.

 

A careful read of the instructions will indicate that anything submitted to the USCIS needs to be in English or accompanied by a translation.

The birth certificate is not being submitted to USCIS but to the consulate.

It's one of the requested/required documents for your interview in Jakarta. Or it was when my wife got her K-1 visa a few years ago. I can't imagine they no longer have that requirement.

 

You can do the translation yourself, there is no requirement to have a formal translation.

Removing Conditions Timeline

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

I'm not familiar with US consulate in Indonesia's procedures, but usually the consulate will accept documents in the dominant local language or English. If only English, translation by anyone who certifies that they are competent in translating between both languages is acceptable. 

 

Birth certificate is not required to submit to USCIS with I-129F. I'm aware of a few attorneys and document preparation services that want beneficiary documents like their passport and birth certificate with the packet to front load the application.

When my fiancee went to the interview in Jakarta, it was requested in the list of things he needed to bring that he bring the original of my birth certificate. In the US Embassy in Jakarta web site there are a number of authorized translators that the embassy approves for English translation of documents.   Not sure if your BC is in Bahasa or some other language.

Bring it! Hopefully that is an easy document for you to find, but in my opinion it is better to have it and not need it, then to need it and not have it!

You don't need to send a copy of your BC to USCIS with the 129F form. You will need it for the interview at the embassy in your country, and in that case all documents not in English or in the official language of the country must be accompanied by a certified English translation.
After you get married and you start your AOS in the USA then you will need the BC to be legalized,translated and with apostille.
