Hi all!

we have seen similar topics in this forum, but would like to ask again on this topic...

We just got approval notice for both 130 and 129F ( we filed both in Feb this year....), and wondering what we should do..

Of course, we want to be together at the shortest amount of time......

Has anyone actually went through the same situation and chose one or the other??

I'm sure lots of us had the choice and made it based on our priotities. Unfortunately, had you been reading other such threads over the past few months, you would already know that you will not really have a choice. Your I-130 will be held at the service center until you are ready for the AOS process. The I-129F/K3 process will continue.

Thank you for your reply, pushbrk! Yes, we have read them, but were not sure if that was still the case. So, does that mean we will not even receive actual NOA2 for 130 in mail either or we will still receive it, but we are not supposed to do anything with it? I am sorry for all these questions, but seems like you are the right person to ask !

Thank you!

I believe the I-130 (CR1/IR1) has numerous steps, touches, payments, movements, etc. between the NOA2 and the NVC sending it off to your Embassy; however, the I-129F (K-3) will not go straight to the NVC and off to your Embassy. You save significant time by pursuing the I-129F.

The bummer is the K-3 is MUCH more expensive now with the Adjustment of Status and EAD (working authorization), versus the I-130 Immigrant Visa allows you to work right away and doesn't require the AOS or EAD.

The I-130 is better, but slower if at the same NOA2 stage (well assuming something freakish doesn't happen with the K-3).

The options you mention effectively went away last November. Now the I-130 is held at the service center instead of ever going to NVC in cases where both the I-129F and I-130 are approved. The rare exception is when somehow they make a mistake and approve the I-130 ahead of the I-129F . This is not one of those cases.

Mine both went to NVC! I guess it all depents how you fill out the question 22 on the form (this is just a guess of mine)

Now, I have 2 (two) case numbers from NVC . One for K3 and the other is for I-130.

It has been almost 4 weeks now since I was given my case number for my K3, still the file is under Admin Processing. That's why I am also following up on I-130. If my K3 sits still for little more- the way it is doing now- I am going to go for I-130 full throttle.

P.S. ; does anybody have any exprience on administrative processing-waiting more than 3 or 4 weeks?

Thanks

As a principal I don't like responding to people with out updated timeline because, if they can't make effort to update their timeline which will help other peoples estimated timelines, I don't have time to help them either.

Also with out an updated timeline, I can't differentiate between a troll and a real person.

Yes, but when? That statement does not establish that they came together. just got could mean a few days apart, maybe more, maybe enough that the I130 makes it to NVC. But a timeline sure would establish when.

Try "just got both" and see if that doesn't compute differently than "just got". Anyway, We can't be sure without a timeline. I just took the most likely interpretation.
