Upcoming interview | Police report/certificate needed from Ukraine (merged)

Our interview is scheduled for next week and I'm concerned about one of my husband's police reports that we have not been able to obtain. He has been able to get his police report from his home country, but he also lived in Ukraine for over 5 years for schooling. As soon as we received our interview letter (6 weeks ago) we started working on trying to get the police report from Ukraine and it has been the hardest ordeal yet (not sure of its because of the ongoing war) we've paid money to try and obtain it, but nothing. It's frustrating!! We are aware that a police report needs to be issued from each country the applicant has lived in for more than 6 months. Will this be an issue at my husband's interview if he does not have his police report from Ukraine?

It could possibly be an issue, but the CO at the interview will determine that.  Worst case is your husband gets an RFE for the report so do not stop trying to get it.  You might try asking the specific question about obtaining the police report from Ukraine in the RUB forum.  Best case scenario is the requirement is waived by the CO.

Special Seal(s) / Color / Format: Effective April 23, 2022, all police certificates are issued online and are printed on a regular office paper of A4 format, with a serial number, QR code and digital stamp and seal. It must all be a “FULL”/POVNA version and list all current and previous names of an applicant.

Issuing Authority Personnel Title: Head of Department

Registration Criteria: There is no registration criteria

Procedure for Obtaining: As of April 23, 2022 Ukrainian citizens can request their criminal certificates if they have no criminal record at this link: vytiah.mvs.gov.ua. Alternatively, they can request it from the nearest Center for Administrative Services in Ukraine (TSNAP)

Certified Copies: Certified copies are not available

Alternate Documents: There are no alternate documents.

Exceptions  None

Comments: For immigrant and K visa processing the police certificates must include all previously used names and surnames. In order for a police certificate to include all the previously used names and surnames, the requestor must specifically state so. The applicants then must make sure all these names appear on the police certificate.

I'm in need of a police report/certificate for my husband before his US immigrant visa interview next week. He studied in Ukraine for over 5 years and we're aware a police report/certificate is needed for any place the applicant has lived more that 6 months. We've been trying to obtain the certificate since our interview date was scheduled 6 weeks ago, to no avail. We've tried internal ministry of affairs and were told to go online which we did, no response. We've also tried the online issuers/court record obtainers, which we paid money to, and they keep giving us the run around. Could the delay and access to receive the report be due to the ongoing war? We want to make sure we have everything required of us for the interview. Could this be an issue for us to get approved by the CO?

Not presenting a required document will certainly be an issue preventing approval.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I'm not very familiar with Ukraine's procedures but I heard they do a lot of things electronically, via the Dia app. @SteveInBostonI130 or another experienced Ukraine user here might be able to help more?

 

Definitely don't pay money to some 3rd party to obtain it, that sounds scammy to me.

How long did is take to have the interview scheduled? I received a notification that the case was transferred to Almaty over 2 weeks ago and still didn't get any notifications regarding the interview date.

Timeline

If you have the Diya app (also called the Diia app), you can request gov documents through that.  The App name is the cyrillic "D" + "i" + reverse R (Ya):  Дія.

 

If you don't have the app already set up, it will be difficult to do so from outside Ukraine.  For identity confirmation, you will need to provide a Ukrainian bank account in your name.

 

There are a few websites that offer "services" to get the Police cert for you, but I would not trust them.  Things have changed drastically since the war and the information I've seen on those sites are outdated.

 

The best method if you do not have Diya is to go to an Ukrainian consulate in your country.  If your country does not have one, try to locate one closest to you that you can travel to.

 

It is odd that you were DQ'd by NVC without the Ukrainian police clearance certificate.

@SteveInBostonI130 thank you for the detailed information. We do not have the app or are we in Ukraine. My husband studied in Ukraine many years ago for medical school in which he was in Ukraine for 5 years. When we were looking back on the DS260 we realized we selected no to the question, have you live anywhere outside your home country for more than 6 months. The answer should have been, yes! So during the NVC stage the certificate was not asked. If they ask at the interview or the question comes up, we want to be honest. The certificate has been impossible to obtain so far. Not sure if the ongoing war will serve as a pass for the CO requesting us to obtain

We have also tried the consulate (outside of our country no consulate inside of country) and were told we may or may not get the certificate back in 2 months

From what I have seen/read, the CO will not waive the requirement and instead will give you a 221g (? - I think this is the form number) asking to submit the certificate.  Let the CO know what the consulate told you about the timing to give you enough time to respond.
