What is the best "evidence" to bring?

I'll just add that I intend travelling to see my fiance in September, we filed our I129F on 05 July. I'm aware that there's a chance I could get turned back but I'm happy to take the risk. I'll take a letter with me from my employer and the deeds to my home and hope for the best.

Does this mean I should NOT file K1 beforehand, as Boiler suggested? I still don't quite get the logic behind that (I mean, we're going to be honest with INS if they ask her status) but if waiting on the K1 for a few weeks lets us visit, then it's probably worth it. Or is INS just concerned that we're engaged, regardless of K1 app status?

Two possible ways USCIS will look at it, before or after applying for the K1:

1) Your fiancee comes over on a tourist visa prior to you filing your K1. She carries with her proof of ties to the home country. USCIS may presume that your fiancee has the intent to immigrate over with the tourist visa by marrying you once she gets into the US and adjusting status. If they believe in the slightest that she has such intentions, she'll be turned away at the POE.

2) Your fiancee comes over on a tourist visa after the K1 has been filed. She brings proof of ties to the home country. The officer at the POE asks your fiancee who she's visiting, and may ask whether she's filed the K1. She may or may not get turned around at the POE if the officer believes she's going to stay, regardless that she's filed the K1. Unfortunately the K1 isn't going to be the guarantee that she goes home.

I hope that makes sense. My point is, what USCIS is concerned about is whether your fiancee has intent to stay, despite whether you've filed for your K1 or not.

People have managed to travel while the K1 is in process - as long as you bring proof of ties to the home country, there shouldn't be a problem. Just be aware that the officers at the POE are allowed to turn you back if they believe there's intent to stay.

Does anyone know where I can find a list of countries that are included in this Visa Waiver Program? And which countries require B1 or B2 visas? My fiancee is Russian so I'm sure its impossible for her to visit me here in the states while we are waiting for the petition to be approved. but I have friends that are interested and they are not members here. thanks.
