is Fiance visa possible? (Merged Threads)

Hi everyone. IM a filipina with a 14 yr old son. He got is citizenship last year thru hiis us citizen father. Im planning to see my son in the US. He left early this year to study in the US and be with his his father who he havent seen for 4 years. 

I do not have a US visa,and im planning to see him. Context: I am not married to the father. we met in another country and he got extradited into the US and he served 4 yrs imprisonment.,so we moved back here in Manila. 

Everyone is telling me there is a low chance for me to get a US tourist visa. I am employed, 6 years in my work. Any thoughts, advise?

Hi everyone. I wanted to see if someone has the same situation as I do. My boyfriend and I lived in Guadalajara Mexico since year 2009. I am a Filipina and he is US citizen . But in the year 2018 he was taken to the US and was imprisoned for 4 years. We have 1 son. We went back to my home country so I can work and support my son and be with my family. I do not have any US visa yet, but my son became a citizen while here in Manila, Phils. citizenship thru his father. 

My question is,now that he is out but still cant travel,  can we file for a fiance visa since we never stopped communicating even when he was imprisoned. He is already out and he wants to be with us, his family.

I doubt the father’s past legal issues play a role at all, but consulates are to assume immigration intent for all B2 applicants.  All you can do is apply and show your ties to you home country.

I thought you said your Son is in the US?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Continuous communication doesn't make you eligible for a K1.  Seeing each other face to face within the previous two years potentially would make you eligible to be petitioned for.

Not likely.  The two year in-person meeting has a very high waiver bar.
