Hello good people,

Please do clarify my worries on this topic, thanks in advance. So my husband petitioned for me and I have been approved . I am about to submit my ds260 can I add in my orphan nephew whom I am planning to adopt before submitting ?Will he be able to come to the US with me or he will do so at a later date? Also, is it better to do the adoption once am in the US as PR?  I have been taking care of him for over three years. Thanks

Do you currently have physical and legal custody.

 

If you have how long have you had it?

 

I see in your history that you have been working in the US for your Embassy and prior to that a J1

 

Is your spouse a USC or LPR.

No.   Due to widespread fraud and international law, adoption related to US immigration is much more complex than just adding a child to a visa application.
