Does CSPA Apply To My Mothers Case?

Hello everyone!

 

My aunt who is a US Citizen had sent in my mothers application as a "Alien Relative" as they are direct sisters with common parents. This was in June and the submission was sent. It had not been approved yet as it still holding a decision time of 7 months from today (October 16, 2023)

My question is that now that I have turned 21 over July. Will I still be applicable under my mom as a dependant minor? Am I covered under the CSPA having my age locked at the date and time of submission being 20 in June?

Another question I hold is that where can I find the general process after (if) our submission was approved?

 

My mother and I are both Canadian Citizens as she was born in Pakistan and I was born in Canada.

 

The field office is the California one.

Timeline

Most F4 cases are approved, with the I 130 you are just substantiating the relationship. Proving that your Aunt and Mother are Sisters. That your Aunt is a USC.

 

Usually they do not rush to approve the I 130s due to the decades long wait.

 

CSPA does not freeze your age, when the PD is current you can deduct the time it took to approve the I 130 from your then age but being over 21 now means you have no chance.

What about this quote from: https://www.uscis.gov/policy-manual/volume-7-part-a-chapter-7

 

"CSPA went into effect on August 6, 2002. Adjustment applicants are eligible for CSPA consideration if either the qualifying application (Application to Register Permanent Residence or Adjust Status (Form I-485)) or one of the following underlying forms was filed or pending on or after the effective date: Petition for Alien Relative (Form I-130);"

 

Does this only apply for people who were only had their form approved? I am not sure about the language behind "adjustment applicants".

Timeline

Adjustment is something you can do if you are in the US in lawful status and your Priority date is current.
