Tourist Visa for brother

Hello Members,

My brother who is a Mexican citizen has Down syndrome. He has had a U.S. tourist, but his visa expired about six years ago. One of my relatives filled out the visa application online for him, but when he went to the interview at the Consulate, his visa was denied.  I have an idea as to why it was denied.  My husband and I are both US citizens and we would like to bring him here for a visit and spend Christmas or Thanksgiving with us.  We certainly don’t want him to migrate here.

1. Can I apply for the tourist visa on his behalf?

2. Can I accompany him to the interview since he can’t really speak well?

3.  Do we have a good chance that the visa will be approved?

Yes, your relative did the same thing.

That would be down to the Consulate, they are interviewing him not you.

What has changed since his prior refusal?

I doubt that helps

In my opinion this hurts his probability to get a visa even more.

Sorry for it.

 

As his guardian they will probably think that you as responsible for him will now try to bring him to leave here even this is not your intention.

Because his past 6 years without a visa, and was not a problem, this could show for the IO your “clearly “ intention to bring he to live here.

Seems to me like it makes more sense for someone local to be his legal guardian.
