Finally received a request for additional info on I-485 (Waiting since Oct 2002). 2 parts to request: 1st part asks for new tax return and evidence of employment or self-employment. 2nd part says unable to determine if household meets 125% of poverty line (Don’t know why asking for this – we had sent in Tax Returns/Pay Stubs and W-2s with the application). Now the need proof we meet it?

Here’s my dilemma my husband (the USC Sponsor) recently left his job and is currently unemployed. Our 2005 returns show well above the 125% line (for 3 of us) – the issue is the letter of employment he is unemployed as am I. Should we just send the 2005 returns along with copies of our bank statements, stock statements and title to our home and state the unemployment? Or send all info stated and send a letter stating self-employment (something my husband is contemplating is to start his own business)?

Any advice or shared experiences on what to submit greatly appreciated.

I used Capital to adjust, some others seem to have had problems. You need to answer the income issues as of now, and if changed, when you have your interview.

I'm afraid I can't offer much in the way of a suggestion for the present unemployment dilemma. If your husband looks to be employed soon (and it's likely that his term of unemployment will be fairly short) then I might wait to gather up the letter of offer and whatnot.

However, it's fairly common through the last couple interviews for people to be asked for their updated W2s and I-864 form. It's probably due to a combination of factors, not the least of which are the impending April 15 deadline to file taxes (when people should have their documentation and statements already in hand) and the length of time it takes to process AOS applications. Circumstances can and do change; therefore, the officer probably wants to know that the USC is still capable of supporting the immigrant(s) he sponsors as much as he was when the process began.

24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!
27 April 2006 - AOS Interview, approved after 10 minutes!
19 May 2006 - 2 year conditional green card.
01 May 2008 - 10 year green card arrives.
09 December 2012 - Assembled N-400 package.
15 January 2013 - Sent package off to Phoenix.
28 January 2013 - RFE: signature missing.
06 February 2013 - NOA 1: N-400 received!
27 February 2013 - Biometrics appointment (Detroit, MI).
01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.
