Working in America when you arrive on a K1

Hi everybody!

my fiance and I are still in the K1 application process but I want to understand what I'll have to do when I get there. I've had a look already but it's still a bit confusing.

What's the difference between an AOS and an AED? (and what do they stand for?)

I've read I can ask for one when I arrive on my K1 but I've read it's not worth it. If I'm right its validity will stop after the 90 days of my K1 or when my fiance and I get married?

So once we get married, what should I do?

Is moving in a different state a problem? Because we might move shortly after my arrival in the USA for my fiance's work. I have no idea of a precise date though.

And finally, how long does it take to be allowed to work? Do I have to renew this autorisation at some point?

From what I've understood, I wont need this autorization when I get a GC. When can I apply for it?

I know that's a lot of questions :blush:

I'm sorry I can't answer your questions about working with the K1 visa. It's not a problem to move around within the US - just fill out the AR-11 (I think that's the right name) each time - it can be done online and is just a free form that notifies them of your address change.

After you marry, you can fill out everything for AOS (adjustment of status). That is what will get you the green card. The new fee for AOS includes work authorisation, so you should have work authorisation (EAD) about three months after filing the I-485 AOS package.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

The K-1 visa it self is valid for 180 days from isuance, or until the K-1 holder enters the USA, which ever is sooner, the K-1 is a single use visa, and is VOIDED as soon as it is used. Then the K-1 gets an I-94 card at the POE valid for 90 days. The K-1 needs to marry withing the 90 days of the I-94. The expire date on the K-1 visa has nothing to do with time in the USA, that date has to do with how long a person has to enter the country.

AOS is adjusting status from non-immigrant to immigrant in the USA

EAD is employment authorization document, K-1 may get a temp-EAD valid for 90 day from entry, some POE like JFK airport stamp the I-94 card with a temp EAD stamp. Marriage does not stop the validity of the temp EAD. Temp-EAD is valid to the date on the I-94 card.

File for the long EAD with or after filing for AOS, EAD takes up to 90 days to get. And yes once AOS is approved the green-card replaces EAD, Green-card allows work and re-entry after international travel.
