Hi all, 

 

I am pretty new to the immigration process so I was hoping somebody here can share their insight. 
 

I just signed the contract with a hospital in the states and my official start date is July 2024.
Their in house attorney is going to work on my h1B visa on Jan 2024 and I am just curious if that is enough time for my petition to processed so I can start on time. 
 

I am a Canadian physician.

Presumably it's a cap exempt position and so you're not subject to the usual deadlines and the lottery? If so, that should be plenty of time for a July start.

Not sure if it’s cap exempt but the hospital itself is non-profit, how do I find out more if the hospital is cap exempt or not?

Sounds like it is, but it's a question for the immigration lawyer.

You can also pay the premium processing fee of $2,500 and have your petition adjudicated in 15 business days! A non profit likely won't cover that, but if you wanted to, they might allow it.

Hi! This is not correct. You absolutely can pay the H-1B check yourself. the form i907, that accompanies it, must be prepared and signed by the employer, but the beneficiary may write the check!

I double checked. I think you're right, the premium processing fee can be paid by employee. Thank you for correcting

for context: I am the immigration specialist for a cap exempt employer and file H1Bs regularly.

 

OP, $2,500 is a lot of money for PP, but it guarantees a decision in 15 business days, or your check is refunded.

You’re right that the normal filing/attorney/etc fees cannot be paid by the employee though, only the PP fee can.

I can try to ask them but not sure if it’s rare to ask that. 

It totally depends. If they're a non profit, they might receive funding from different sources that don't allow for this type of process, so the employee has to pay by default. We do not, in our organization, but unless you ask, then you won't know,
