My Mom green card got delivered to wrong Adress [merged threads]

I am Panicking and devastated ! My mom's green card was Delivered to the old address a month ago which is another state i called the landlord and the Tenant is currently  moved out and the USCIS and Nobody can locate it .

In the tracking number it says delivered to the Old ddress.

 I  change a new current address on the final interview as well and when she entered the country and still they sent it to a completely different address. The USCIS representative said she only saw the old address in their system 

I am trying to fill Non-Delivery of Card form and it asking me for the form number which form number should i put in the form please help 

 What should I do?

Thank you Yes, First green card was delivered to wrong address and never got it and I was able to submit using  OS155A and as per USCIS  the only way i can get my mom green card replacement is by filling  I- 90 form .

and now I am filling I-90 form 

But i have a question On the form if you can help me please

on the question

Where was your immigrant Visa or Adjustment of Status Granted ?

From the beggning i filed everything online and i never recieved notification from USCIS except the i-130 approval notice now i don't know what to answer for this question because i don't know which office grant her Green card  should i put the location of US embassy abroad where she recieved her vis?

Immigrant visa was granted at the embassy. List it.

I am the petitioner for my mom using an online I-130 form for the IR5 visa. Her I-130 was approved, as per the NVC I-797 notice received from NVC at 32 Rochester Avenue, Portsmouth, NH 03801-2909.

Her IR5 visa was issued at the consular office abroad on March 20, 2023.

Unfortunately, the first green card was delivered to our old address and was lost in the USPS mail. We have not received it, and it's been three months now.

I have a couple of questions related to the Form I-90:

What should be the reason for the I-90 form? Is it a DHS-issued card but never received, or should the reason be lost or stolen? Which one should I select?

For the question "On what date did you become a permanent resident?" What should I put? Should I use the date she got her visa at the consular office abroad, or should it be the date that she entered the United States with her immigrant visa?

Also, how can I request a waiver for the payment, considering that USPS admitted in an email that they mishandled the mail and that it was their fault that her green card was lost?

2.  Date she entered US. It is also in her passport stamp. 
3.  You will have to repay the I-90 fee. Did you file AR form to change her address?  What address did you put on her form when you paid the GC form?

 

Also USPS by law cannot forward your GC to a new address they are required to return them to USCIS. USCIS will reissue a missed mail card issue without the filing fee paid and another biometrics conducted. 
 

You can try to do the waiver, but the I-90 will get denied.

Yes, I changed my address on my USCIS account. However, when updating the address on my USCIS account, I  used my name instead of hers, and the system didn't allow me to update it with her name.The USCIS agennt said the adress was not change with the new reciept number 

I then attempted to create a different USCIS account using her receipt number. To my surprise, I discovered that the change of address request had been rejected. This situation has become quite confusing.

 

How should I address the issue of a missed mail regarding the green card without having paid the filing fee again and without her undergoing another biometrics appointment? Should this process have a risk of getting denied ?i prefer  paying the payment again than getting rejected ? please what do you advice?

You moved and did not change her address. This is her immigration file not yours, they are not connected. You should have changed yours and hers when you did the AR form. 
 

I gave you that advise already. 

Will NOT reissue a missed GC without payment of filing fee and a new biometrics

My wife's daughter brought her husband over here (I-130) after successful Consulate Interview on June 23rd, 2021. On June 24th we used USCIS address change tool to change his address as we had moved since the application. They said to expect his green card in 90 days. It never arrived so we filed an I-90 (green card replacement form in October 2021) and selected the never received option which does not require payment of I-90 filing fee. Over the past 3 years we spoke with them and they finally told us his green card was delivered to our old address, is considered lost/stolen and we had to refile another I-90 and pay the fee. Two weeks ago we received an RFE (request for evidence) which demanded we prove his green card was never delivered. According to USCIS the card is "delivered" if it is not returned to USCIS!

 

In a last ditch effort I scoured my emails for any hint that we could prove our position. We found an email from USCIS with a confirmation number from June 24th, 2021, proving we filed a change of address on June 24th, 2021 which is a full 35 days before the card was mailed to our OLD ADDRESS! 

 

The USCIS website states, "If you moved to a new address prior to your Permanent
Resident Card being mailed and did not change your address with USCIS, your Permanent Resident Card 
is presumed lost/stolen."

 

By virtue of the email receipt we proved we had changed his mailing address a full 35 days before it was mailed in compliance with their requirements. 

 

The USCIS website also states filing a change of address, "This meets the 
legal requirement to notify USCIS of a change of address."

 

Our official response was a letter signed from him stating we followed all of your requests, submitted a timely address change which was acknowledged by USCIS with a confirmation code. We reminded them we followed all of their requirements, changed our address in a timely manner, but USCIS mailed the original (wrong) address anyway and demand we prove it was not delivered!


This morning we received a message from USCIS that "We have approved your Form I-90 Application to Replace Permanent Resident Card, Receipt Number IOEXXXXXXXXXX, On September 10, 2024, We ordered a card to be produced. We will mail your card to the address you gave us.

 

We are elated! we called them out on their requirements and received this amazing news this morning. 

 

We are with you in this struggle! My wife, Natalya and I, will celebrate 10 years on 9/15/2024 since we met online and we are still on our honeymoon! If you have love you have everything! You need nothing more!
