I-751 divorce and remarriage.

Hi, I'm Jenya,

I arrived in the USA June 2021. My husband wants to divorce me. He told me to find a younger man to be the father of my children.

I met a great man. We are engaged. My husband says that we should get married as soon as our divorce is final.

My fiancé and I talked to an immigration attorney. He said that a quick marriage might be a problem for my I-751.

My husband told me to ask here.

He will give me a litter like the attached.

Should I be worried about my I-751 with such a fast remarriage?

I don't think this is a typical scenario. USCIS may be confused and suspect marriage fraud. At the same time, if current your marriage is not going to survive:

1) Divorce

2) File I-751 with divorce waiver

 

I wouldn't remarry for some time. Take a break, think about your goals and get to know your new partner.

you can only adjust status thru current husband or with a divorce and a divorce waiver

finding a new husband while still married does not look good

 

i would suggest going a little slower 

i am not judging just looking at this from the eyes of immigration

 

hope u can be happy

perhaps get a consult with a good immigration lawyer

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I would not send that letter, nor would I rush into marriage. 

 

For a start, the letter is kinda strange (USCIS doesn't care that you like to dance and/or are good at dancing, or that 'Jeremy' likes gaming, and while the disappearing tenant is a curious little subplot, it's not relevant to your immigration journey). 

 

And the timing is very quick.  You married in 2021 and, in 2023, you're already divorcing and have a new partner lined up.  I would focus on the divorce.  File with the divorce waiver.  You and Jeremy have a wonderful life ahead, by the sounds of it.  I would not mess it up by acting in haste.  I wish you good luck!

That affidavit may do more harm than good. I'd not submit that. I wouldn't marry, either. Not until well after ROC is approved.
