B-2 Tourist Visa / Girlfriend visit to the US

Hello Guys,

I have been reading some replies, but would like to get a catered response to my specific situation if you guys could help please.

I'm from the US and I met my girlfriend online almost a year ago now. We would like her to come visit me at the end of December into January with a B-2 Tourist Visa and also get married as well during her visit. However, we do not want to break any law. Our intent is for her to return to her country (South Africa), job (9 years, Finance), home, family, vehicle, phone, etc. and for us to begin the I-130 (green card) process. We are both around 40 years old. She's white by the way. I'm not racist at all, but in our messed up world it matters to an extent unfortunately. I just want you all to have all the facts when you respond.

 

Given those circumstances, do you guys think we'll have a problem in getting the B-2 visa or any problems at the Port of Entry in the US if we are telling the complete truth and can prove all of the above facts? We are getting ready to apply, but I'd like to get some thoughts about our situation beforehand.

If you both have plans to marry, she would probably be denied the visa.  It depends on CO and CBP.  It has been approved before, as we have seen, but it really is a toss up.

Your plan to marry inside the US, then leave is legal IF she can get a visa.  No one here can accurately predict whether the CO will approve the application.  It costs only a relatively small amount to know.  Luckily, it appears she can get an appointment pretty quickly.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There was a case I remember from a few months ago, she failed the first time but got a B the second time, maybe a bit older than your GF.

 

Last I heard she decided to stay and they filed to adjust.

she should not bring paperwork like  a resume , that make it look like there is  intent to stay as that alerts CBP 

 

Look at your state requirements  to marry and don't even bring a birth certificate unless it is needed to get married

 

Marry here if granted the tourist visa and she returns home after your honeymoon/  don't misuse the tourist visa  and try to AOS as this reuins it for others that follow
