Hi there,

I am a little confused between the K1 and K3 visa. I am marrying my fiancee in Singapore in September, but we are migrating over to the US immediately after. Someone has advised me to take the K3 visa instead of the K1 visa because the fiancee visa(K1) is not applicable for me in this situation. However I do know someone who applied for the K1 visa, had it approved before her wedding in Singapore and she went back to the US after the wedding here. Is that possible? :o

I need to know

1) what are the forms i need to fill out for the K3 visa or are there any alternatives for us?

2) how long approx does it take to get it approved (K3 visa)

3) is the marriage documentation in Singapore enough evidence that we are married?

4) is it harder to get the K3 or the K1 visa

5) What other types of evidence do we need to justify the spouse visa?

6) Is my wife allowed to work in the US when she gets the K3 visa approved?

7) I understand that if she comes back with me to the US after the wedding, she will still be on tourist visa (because the K3 visa is still pending approval). So does this mean that if the K3 visa doesnt get approved during the 3 months period that is allowed for tourists, she would have to go back to Singapore and then come back again only when it is approved? Will this affect the approval of the K3 visa because they can track the no. of times she has been in the US and thus, they will need me to justify all that?

Darn, this will mean that we have to spend loads of money flying to and fro. Plus i dont want to be separated from her after marriage!! Can someone advise please? Really appreciate it! :help:

6. Yes, after getting an employment authorization document. That takes about 90 days from date of entry into the US on a K-3.

7. You CAN NOT USE A TOURIST VISA TO MOVE TO THE US. If she obtained a tourist visa prior to her marriage, she will have to get another one after marriage. If your wife uses her tourist visa to "move" to the US permanently, and USCIS finds out, your wife will be subjected to a ban from the US. Yes your tourist visa will affect the K-3. I'm sorry you have to be apart from your love one. Most people on this forum are in similar situations with their loved ones. If you don't want to be apart from her after marriage, then you should consider staying in Singapore and living with her until she obtains her K-3.

We seem to have a situation where semantics is important. A wedding (an event) and a marriage (a state of affairs recoginzed by governmental authorities) are two different, albeit related, things. A wedding does not necessarily create a marriage - sometimes it does, often it does not.

In the case of the someone you know, it may well have been quire proper for them to have a wedding and then travel to the USA on a K visa - if the wedding did not create a marriage.

In your case, you say that "I am marrying", in which case your fiancee will no longer be a fiancee and she will not be able to use a K visa.

Please clarify and state accurately what it is you wish to do.
