Hey guys, I’m back again 😊

Kindly assist to shed some light on my tax issue. 


We filed amended taxes for 2020 and 2021, got a mail from IRS few days ago saying they cannot pay us. 

Their reason is that we have passed the grace period to amend for those tax years. But we can appeal within the next 2 years blah blah… I’m confused. Is this correct? If not, what can we do to get our money from them? 
 

My ROC window opens April 17, so we will have 2022 and 2023 joint taxes. Is there likely to be an issue if we can’t provide joint taxes for 2020 and 2021(we married in 2020)?? 
 

I kept the letter from IRS to show USCIS in case they ever want to move mad because of the taxes. 
 

Please advise! 
 

NB: IRS are a joke man. Apparently my wife owes them from 2020, so they kept my 2022 refund. Now they are asking us to pay what she owes but they won’t pay us what they owe us?? I find this very corny and funny 😃

It may not be too late if you’ve made a mistake (irs.gov)

 

"Well, you may be able to amend your tax return which could result in a refund. If you are within three years from the date you filed your original return, you can amend your taxes by filing Form 1040X."

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you, Crazy Cat. Both taxes are within 3 years of the original filing. So, what do you think we can do now? There is overpayment on both.

We elected to receive, both amended taxes gave us a refund. How do we fight them for our money?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

you use that site by printing out page 8 and make an appointment at nearest IRS office

They don't owe you anything until she has satisfied her debt to them. That's how it works.  Follow their appeal process as listed on the letter they sent.

Page 8 doesn't apply unless he pays quarterly estimated taxes.

Follow the appeal process they listed first or hire a tax attorney.  That's all you can do.

If u owe for any year,  then this oerpayment will be used to help satisfy the debt

 

amount owed,  plus interest and penalities 

 

get a payment plan

1. In 2020 amd 2021, did you have SSN/ITIN? 

2. What status did you use to give taxes thzie years? MFJ/ MFS? Nada?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
