Hey Timona,

1. I had neither plus my wife wouldn't apply for ITIN for me.

2. 2020 HoH 2021 Single.

UPDATE!!

 

I just checked IRS where's my amended return and it says the 2021 has been adjusted (October 6), it was received March 8, we are supposed to hear from them within 3 weeks. This doesn't make any sense after they sent that letter.

The 2020 was received June 27 so I am guessing it's too early.

is IRS messing with us??!!

What is the total amount owed to the IRS?  It could be that your anticipated refunds are less than what needs to be paid.  Once the amended tax returns are filed, the IRS will only send you a refund if it is greater than the outstanding taxes (plus fees, late penalties, etc.).  They will reduce the debt by the amount of the refund.

Actually I logged into wife’s IRS account this morning, the debt is from 2019 tax year. With penalties and interests, it was (we have paid it off now) $1,095.16. 
Now we wait.

We filed amended taxes for 2020 and 2021, got a mail from IRS few days ago saying they cannot pay us. They cannot pay you because you owe them money or because you filed incorrectly?

Their reason is that we have passed the grace period to amend for those tax years. But we can appeal within the next 2 years blah blah… I’m confused. Is this correct? If not, what can we do to get our money from them? 
 

My ROC window opens April 17, so we will have 2022 and 2023 joint taxes. Is there likely to be an issue if we can’t provide joint taxes for 2020 and 2021(we married in 2020)??  - Didn't your wife already show NVC/The consulate her 2020/2021 taxes? It won't be an issue. You only need to show them proof of bonafide from the day you arrived to the US to when you file ROC. It is about updated  proof not proof they've already seen. 
 

I kept the letter from IRS to show USCIS in case they ever want to move mad because of the taxes. - They shouldn't get mad... Key word is UPDATED proof.

Hello Oko, has there been any update? I also got the same letter which stated that my claim has been disallowed because my spouse’s SSN was issued after the return was due and I cannot retroactively file MFJ.

Hi Karay,

 

They didn't pay us. 

 

However, I intend to include both 1040x forms in my ROC to show we did amend to filing jointly even though we didn't get paid. Has to count towards financial comingling
