Waiting on spouse visa interview - petitioner moving

So I am the U.S. citizen and we are waiting on the linteview letter for my wife interview in Nigeria . I apply to transfer to a different apartment in the same complex due to mold growing in the vent. I haven’t been approved yet but most likely I will to move on Nov 3.

i haven’t updated nothing yet cause I haven’t been approved yet .

 

my question is who do I contact or do to update my address for immigration? 
 

I hear different stories online from filing out a I-865 form since I file affidavit of support to a ar-11 form. I am confuse 

 

I can’t do the within 30 day thing cause I haven’t been fully approved yet .

The person who signed I-864 needs to notify USCIS with I-865 within 30 days of moving. A copy of I-865 should be brought to the interview and offered to the CO.

So as long as it’s not pass 30 days I am fine? 
 

since I am waiting on approval for for Nov 3? 
 

I won’t know of my approval until 

Monday .

 

so it’s not 30 days 

 

confuse I am the timing ?

Have you moved from the addressed you listed on your I-864? This is a yes or no answer.

No I am not moving until Nov 3

 

but still haven’t been approved yet waiting on the official approval. 

 

We waiting on the interview letter for the spouse interview in Nigeria

Then, assuming you move on Nov 3, to avoid a federal penalty, you would file I-865 on or before December 3. As December 3 is a Sunday, I suggest you mail this by December 2, and get proof of mailing if you wait until December 2. If you mail this on or before November 17 with USPS flat rate priority mail, then the tracking will be proof of mailing.

While I am curious what benefit you see in not following the instructions, I perceive that you do not want to file I-865.

 

Thus, I’ve contributed all I can, and I don’t wish to argue or bicker, so I won’t post more in this thread.

If your wife has not interviewed yet, there's no need to send an AR-11 or I-865 form to USCIS nor the consulate.  To update your address, do the following --

  1. Fill out an I-864 form (not I-865) with your new address info.  You may need to update your financial info as well.  Make sure to sign and date the form properly.
  2. Scan the updated I-864 form and upload to the section for "Additional AOS Supporting Documentation" on CEAC.
  3. Email the I-864 scan to your wife.  I recommend you also paper-mail the updated I-864 form to her, so she can bring it to her visa interview.
  4. On the day of your wife's interview, she should request the consulate staff for assistance to update her DS-260 form with your new address info.
  5. When your wife flies in to the US with her spouse visa, she should provide your new address info to the inspecting CBP officer at POE.  She should make sure to volunteer the info in case she is not asked.

No need to do steps 1-3 within 30 days of your move.  I suggest you wait until your wife gets her interview schedule so your new I-864 will have the most updated financial info at the time.  You may as well upload your latest financials documents then, as there's a good chance you will be required to provide your 2023 tax documents by the time of your wife's interview.

 

If you ever change addresses again after your wife enters the US with her spouse visa, then you will need to submit I-865 to USCIS within 30 days of moving.

I already completed the I-864 it’s been uploaded and approve like two weeks ago . We just waiting on interview letter .

Do not forget to foward your mails to your new address with USPS.https://www.usps.com/manage/forward.htm, it might take a while for USCIS to effect your address change....meanwhile they will be sending correspondence to your old address. This has messed up alot of immigration cases...AVOID IT AT ALL COST

This is correct...BECAUSE no I-864 is yet in force.  The OP should read the above carefully and follow those steps, and ignore previous incorrect advice concerning the I-865.
