Traveling with receipt from wrongly filed i90.

Hi there,

 

We accidentally wrongly filed an i90 instead of a i751 and are now filing the i751 6 months late with cover letter explaining the mistake. We had planned to travel outside of the country but now are concerned with the possibility of not having the receipt from i751 when reentering the country in 6 weeks. 
 

The i90 receipt does say that the green card extends for 2 years, but this was obviously not the correct form to file and will be rejected eventually. 
 

Does anyone know if my wife would be kept from entering the country if we did not yet have the i751 receipt?

She needs her expired Green Card and the valid 4 year extension letter received after filing the I-751.

Cannot travel on I-90.

Should wait for I-751 receipt and travel with that and expired GC.

Her conditional GC is expired. Lacking  a pending I-751, as far as DHS is concerned  her LPR status will have expired. I am certain she would be admitted into the country, but I fear she would get an NTA, or worse, and NTA and be turned over to ICE for detention pending her removal trial trial.

 

Having filed 6 months late, even if she gets her 48 month extension letter, I think it is too risky for her to travel outside the U.S.

I recommend postponing your trip until after you get the extension letter from filing I-751.

With the expired GC and the I751 extension letter, the risks should be very low.

The risk is that after you get the receipt, USCIS denies the case while your are outside the U.S.  If you arrive at a port of entry with a denied I-751, you might up in ICE custody.

 

As there are others discounting my caution, I suggest you start with  

and follow the thread to link to the video that documents the incident.

 

In fairness, I was equally naive about this until I heard about about the case. The power CBP has is extraordinary.
