There was a case I saw where the Lawyer booked an appointment before it was approved and they had to start again. I thought you said earlier it was less than 6 months but whatever it is you have to allow for, So approved I 601a, Consulate appointment after the x months and Immigrant Visa, assuming you have no other way.

Yup correct! If we take the I-601a route, the 44 months for the approval is literally the longest period which is insane.

I 601 seems to be about 18 months but first you need to be interviewed at the Consulate and refused for the overstay.

 

Not sure I see how a I 601 comes into this otherwise but the story is confusing so I could have missed something.
