I-864 while "living abroad temporarily"

I currently find myself in a unique situation regarding my I-130 application. I am at the NVC stage and need to submit an I-864. Since I am currently visiting abroad and have let go of my place (planning to get a place once the app has been approved), I am uncertain about what to specify as my physical and mailing addresses.

I do have a US bank account, which I intend to use as proof of domicile, but I am unsure about the address details. Is it acceptable to use a friend’s address as my own? Alternatively, I could list my foreign address and provide an explanation that I plan to stay overseas until the visa is approved, so my spouse and I can travel together. I want to ensure that I provide accurate information while meeting the requirements of the application.

Seems like a weak case for domicile unless your state of residence is California or is like California and does not re-issue a  DL for an address change.
 

If California or like California, notify the DMV of the new address in your state, and include the DMV’s confirmation of change pf  address of record (to friend’s house) in your evidence of domicile.

Timeline

You should complete a timeline and let the VJ community know what state ,  where u intend to live if the visa is granted and that her country is Moroc

U not only need to provide proof of residency

u need US tax returns to prove income or a Joint US sponsor

 

So,  what state ,  as some require u to change residency in person to update the DL

Thanks for your message! I have a steady income that's more than enough to cover all the folks in our household, which is what we need for our application. I'm also good about paying my taxes and have the tax returns and transcripts from last year (2022) to prove it. Also, my driver's license is from North Carolina, which is where we're planning to live.
I had my own place, but I made the decision to break my lease and visit Morocco a couple of months ago. At that time, I didn't anticipate our application being approved. However, here we are, needing to file for the NVC phase, and I'm uncertain about the options available to me at this point.

Order a NC DL online: https://www.ncdot.gov/dmv/help/moving/Pages/moving-within-nc.aspx

Do I update my address to reflect my friend's house? and use the new license for proof of domicile? or what am I looking at here?
I currently do have a valid NC license but since I'm overseas the address is not longer valid. I was going to use my bank with my friend's address as proof of domicile. Is that not valid?

It's ok to use your foreign address as your current physical address on your I-864 and your spouse's DS-260.  Your mailing address can be any US address where you can reliably get your paper mail.  There's always a chance that USCIS address change will not work for your spouse after US entry, so if you are ok with their GC and SSN card being sent to your friend's address, then list that as your mailing address.  Also, on the I-864, list "USA" as your "Country of Domicile", even if you list a foreign address as your physical address.  Just make sure to upload your US domicile evidence to CEAC.

 

No need for your mailing address to match your current physical address nor your future intended address.  Also at NVC stage, no need for the addresses on your domicile evidence documents to match the addresses listed on the I-864 and DS-260 forms.  You are allowed to move addresses during your spouse's visa process.  That said, you or your spouse should be prepared to explain your domicile situation to the CO at the visa interview.  Seems like you already have that covered.

Per NC law you have to change your address on your DL when you move. So you need to do this anyway.

 

If not your friend’s address where else?

 

So do as I suggest that, cancel your DL, or  get a DL from the jurisdiction you are living at now.

But your friend’s address is

I forgot to mention that I have a po box setup where all my mail goes to and my friend does scan my mail for me.

can I use a po box to receive in my i-864?

Like i mentioned in my previous comment, i have a P.O. Box setup which i can use as my mailing address if I'm allowed to. So use my abroad address as my physical address and P.O. Box as my mailing??

 Domicile evidence? What should that be one more you know my situation?!
