My husband recieved a RFE today in the mail. I'm a little confused by what they want exactly and what the statement means exactly as well. So I would appreciate any help anyone can give for us! thanks!!

RFE states it's request for initial evidence for I-485. It's the blah blah about being unable to complete the processing b/c they need more info. Info needed is "F. (40) The sponser or joint sponser (if required) on Form I-864 Affidavit of Support must submit the following: W-2's, 1099s, and/or all schedules submitted to the IRS - a copy of his/her Federal Income tax return was submitted and/or the sponser or joint sponser requested an extension to file his or her Federal income tax return"

Now is all they want what we already sent with the I-864? The proof of income correct? I was a little thrown off with the info following "IRS" and just wondered if that is the standard request they send out for others who've needed to resubmit their tax info. ?? I have not filed taxes in years b/c I am on disability. I did submit proof of that income AND a letter stating why I did not have any tax info to submit. My dad/his wife did a joint sponser for us. We sent in their last years tax info like we were supposed to. Do they just want us to send this all back in again like others have had to do?

Also, it states on this RFE - "You are ineligiblefor interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii) until ninety (90) days after the missing initial evidence is received." What does that mean? He applied for a EAD as well and I'm assuming this pertains to that application, but please don't tell me it means he has to wait a whole 90 days AFTER we resubmit tax info to even get granted the EAD? :help:

as far as this part is concerned (mine stated the same), i believe, as other do, that it is simply to cover their own butts if you take forever to respond to them

09/06/07: EAD Card Production Ordered (Day 77)

09/12/07: EAD Card recieved in the mail!!! (Day 83)

09/18/07: Interview in Atlanta!!!!!!!!! (Day 89) APPROVED PENDING NAMECHECK!!!!

Ah ok well that makes me feel better about that! Now I just need to know what exactly they want from us so we can send it in. :wacko:

lots of times they simply "loose" what you sent in, so it could very well be for what you already submitted. i would just resubmit the same info, but beef it up with a few more years paperwork from yourself and you sponsor

That part basically says that once they receive what they are asking for then the processing of your EAD will resume again along with the AOS.

I got that as well when i was REF'd for tax info.

You are now the 5th person, myself included, who got this RFE recently. *sigh* Ok yes I'd prefer they lose this rather than medicals but still.

I didn't know if maybe I missed something or whatever so I sent them a copy of my, and my co-sponsor's, entire federal tax return. I also included a cover letter stating (in bold) that I sent a copy of the entire tax return because I didn't know if maybe I missed something in what I'd sent earlier, but the W2s that they specifically wanted ARE included. I didn't want them to look and see a tax return and just toss it aside thinking the W2s wouldn't be in there.

Sorry to hear about this. Please keep us updated because I am all worried about ours. I sent in 4 years worth of tax information so I am hoping we do not have that same sort of thing happen. Maybe they just use this to by them time or something. :(

Ahhhh #######! NOW I see what I did wrong!! I totally FORGOT about getting copies of the w-2's to send along with the tax info. Shoot! I don't know how I didn't put 2 and 2 together when I seen the RFE asked for the w-2's. :blush: Now I just need to get my dad to get copies of their w-2's so I can mail them back in fast. :whistle:

I have another question though. Does anyone know if its possible to add a co-sponsor later on if you are RFE'd for more financial information? When we submitted, I only made over the poverty guideline in the most recent of the past three years, and i'm concerned that they will ask for a co-sponsor.

This would only be relevant if a sponsor or co-sposor requested an extension on taxes due to them being late or having a need to file at a later date. You should be fine if they have always filed on time, but be sure to send in everything one each sponsors taxes and your own if you have them. You should also put 'N/A" if a extension has never been filed.

You should be able to add a co-sposor especially if you are RFE'd for more income information, but be sure that if you are adding one, that you write a cover letter stating as such and send in the entire I-864 for the new sponsor includin all the relevant backup documentation...even if this is something that they don't allow (which I do not see why they wouldn't) then it would still be worth a try and you never know.

For all you guys and mainly people just going to file. Get tax transcripts from IRS for the last 3 years and send them in with your AOS application.

Can do for a RFE also.

They carry a LOT more weight than anything else you can send in as they show you definitely filed.

ITRS and W2s don't necessarily mean you even filed to IRS and also can be fakes.

I've "heard" USCIS may even require them in the future in some situations.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Well I have never had an RFE, but if they are asking you for something that you don't have then N/A would be the best bet because it's not applicable to your case.... does that make sense?
