I130 Expediting

Hello everyone,

 

I heard that USCIS usually denies all the expedite requests unless its an emergency. However, I was wondering what if your wife has a mental illness because of physical separation that triggers her another health condition, gerd diseases to increase more and it gets to a point where it starts damaging her stomach and other parts of the organ. She has stress, anxiety, bad sleep, depression, and when she gets sick, it doesn't heal.. it takes 2-3 weeks longer to heal because of this condition. Can she goto a doctor and get a report of her health status and use it as a evidence so that USCIS can approve ? I believe this is emergency because if it left untreated.. it lead to more many serious mental health and her stomach will have a wound and might need surgery. Would this a reason for USCIS to approve ?

You can always try but I doubt it. But it is not me that makes the call.

 

Maybe also look at a B2 Medical.

 

The thing that worries me is that it sounds she has not sought Medical help.

If “left untreated”?  Why would treatment be dependent on whether your visa was expedited?

 

That is not an emergency situation, and I would expect an expedite request  to be denied .

The only solution is for her to seek medical care in her country.   They will not expedite for a non-emergency medical condition of beneficiary.

Because the only treatment is that I need to be with her (I'm the medicine for her).. in order for her to heal. If im not with her for a long time, who knows what will happen to her.

That is going to be a very difficult Medical prognosis to sell.

I would start with making sure your Spouse gets Medical treatment, I certainly have no idea what that would be, Something a Doctor needs to address not VJ.

You need to be more supportive of each other. Do not shoot yourself in the foot down the road, with this becoming a permanent codition on her paperwork. If she magicaly heals, everytime you are around, make sure you book a trip any time medicine is needed. Otherwise, be more supportive of each other through this agony of waiting we all are going through believe or not. I do wish you a faster process then ours from bottom of my heart, but please do not sabotage yourselves with this nonsense.

Thank you for your support. However, I have personal issues as well. I'm currently umemployed, and I have at least 30k tax debt and other debts as well as monthly payments. So I can't really book a trip anytime I want. Should I also include this in the expedite too ? Also I have a down syndrome brother and my dad will have meniscus leg surgery very soon. I can have documents for all these things i mentioned

Has she seen a Doctor?

I wouldn’t disclose your financial situation at this point since there is sponsorship support that is needed for later step, the nvc. USCIS had pretty transparent guidelines about what emergencies count. Maybe just to sit down and talk, basically we know that we want to be together and are aware of obstacles we need to overcome, and let’s get through this together, it is what it is? Something along those lines.

Have you thought about re-locating to her country?  That would solve one of your issues.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
