We filed for DCF (spouse of US citizen) in 2009 at Abu Dhabi Embassy. In those days DCF was more broadly permitted and the A-Z timeframe could be a month or less if all went well. In our case it didn't.

The visa officer told us that she had determined that the marriage was bonafide (means I-130 was approved?) However, she issued a 221g requesting further evidence of US domicile of petitioner.

Thereafter, we failed to pursue the application and I understand that it was eventually terminated by the Embassy due to inaction.

 

I guess I need a lawyerly answer as to whether there is any legal basis or procedure to reopen that case, instead of filing a new petition with USCIS. I realize the answer is probably negative but wish to exhaust this option in case there is any basis out there.

You cannot submit an I-290B to appeal a decision by a CO at a foreign consulate. I think you have to start again.

Form I-290B, Notice of Appeal or Motion (uscis.gov)

 

Who May Not File Form I-290B?

1. If you are the beneficiary of a petition or an attorney or accredited representative of the beneficiary, you MAY NOT file an appeal or motion unless otherwise instructed by USCIS and as specifically permitted by law. Only an applicant or petitioner may file an appeal or motion. Similarly, an attorney or accredited representative MAY NOT file an appeal or motion on the behalf of a beneficiary.

 

2. Do not use this form to file an appeal with the Board of Immigration Appeals (BIA). The BIA has jurisdiction over appeals of Form I-130, Petition for Alien Relative, and Form I-360, Self-Petition for a Widow(er) of a U.S. Citizen. You may file an appeal with the BIA using Form EOIR-29, which is available at the USCIS website at www.uscis.gov/eoir-29 and at the Department of Justice website at www.justice.gov/eoir/list-downloadable-eoirforms.

 

3. Do not use this form to appeal the denial of a U.S. visa application by an overseas Department of State consular officer (for example, Forms DS-156, DS-156E, DS-156K, DS-117, DS-157, DS-230, or DS-260). For information about U.S. visa application denials, visit the Department of State website at http://travel.state.gov/content/visas/en/ general/denials.html.

 

4. Do not use this form for appeals of Special Agricultural Worker or Legalization applications. You must file these appeals on Form I-694, Notice of Appeal of Decision Under Sections 245A or 210 of the Immigration and Nationality Act. Form I-694 is available at www.uscis.gov/i-694

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You could try for an expedite.

Start again seems to be the order.

If you have to repatriate due to a work commitment, there is still a possibility you can attempt DCF.

I am going to assume you have done nothing to keep the I 130 alive?

You chose not to respond to consulate because you chose not to move back to the US since 2009. 
Know you will face exact same domicile issues . So prepare to meet criteria for Establish or Intenr to Re -Establish .

Not sure how I could have kept it alive. I did write to the Embassy inquiring about the application two years later and was informed that application had been terminated after two annual notices (dates provided) were sent out (neither was in fact received by me). Also, they pointed that I could file a new petition with USCIS.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
