I found this link:

http://www.immigrationcases.com/art-01.htm look under "Part II"

I can't vouch for its accuracy, but it has a more detailed discussion than I could find anywhere else.

Yee2007,

My advice would be to find an immigration attorney to help with your immigration status, and a family law attorney to help with divorcing this unsavory man you have had the misfortune to marry. There are pro-bono (free) immigration law services. We may be able to help you find one if you tell us (only approximately) where you live.

It looks to me (not an expert!!) like you would need to prove abuse. If this man is preventing you from working or visiting your relatives, that would be a good start in my opinion. How long have you been married?

You may want to start quietly collecting evidence that your marriage was in good faith, and evidence of his mistreatment of you. Start educating yourself about your situation. Coming to VJ was a good first step, but you need more help than we can give you.

To the board... isn't this what Shona did?

Best wishes to the OP.

Maya
