how long to change refused status? 9/21/23

Hey y'all,

 

Here's the story:

 

our process started in nov 2020, during the pandemic, and it has been long and arduous. my husband, who is a canadian citizen and lives in canada, had his interview in nov 2022 in montreal. he was refused and asked to get supporting documents because of a DUI on his police record from several years ago. he got the documents they asked for (including a letter of support attesting to his sobriety for the last 10 years from a dr. that the med examiner suggested). it was accepted. next, they asked him to do another medical exam since the one from last year had expired. we did that, and the medical examiner said that everything looked good. they asked for a new police certificate because it had expired. we did that and received proof from the courier that it was received by the consulate. we have submitted all of the documents that they requested from us. yet, the REFUSED status has not changed all month.

 

today, he got an xray cd from the medical exam with instructions for him to take it with him into the US and NOT to give it to border officers when he enters the us. is that a good sign?meanwhile, the ceac status still says REFUSED. sheesh.

 

my question: what do we do? how long might it take to for the status to change?  is there someone we can write to or talk to that can let us know what we should be doing? do we just wait? our process is taking a long time. my husband is still in Canada, and the consulate in montreal has had his passport since nov 2022, so he hasn't been able to travel to the US for almost a year. the last thing they asked us to do was in the beginning of sept 2023. any idea of what the next step should be and how long it might take for an explanation of what's going on or a change of status?

You may try contacting your US Senator or US Representative to send an inquiry to the Consulate on your behalf, but YMMV.  It is hard to say how long the "Refused" or "Administrative Processing" status will take, some are short and some are quite long.  The only other option, other than continue to wait, is to look into a Writ of Mandamus.
