K1 Process for Russian fiancee questions

Hi All,

 

I finally got my NOA2 after 11 months, California Service Center where the petition had been sent to was estimating 16.5 so I feel lucky. Now a new set of questions arises. Which are making me nervous, so any helpful responses would be appreciated. Maybe someone else out there has the same questions and this can help them too.

 

Basically since embassies in Russia have stopped processing visa's and Poland is a bust because of such bad relations, we want to move our case to Costa Rica ( for several reasons )

 

Here goes:

1. Does DoS / NVC ever mail anything to the Fiancee or does all mail come to me, the petitioner ? << Everything I have found indicates the mail gets sent to the petitioner but everything is a little vague.

2. Does anyone know the process ( details ) for moving the case to another country ? << After USCIS approves the petition, they forward it onto the NVC and the NVC takes 4-6 weeks to process. It is during this time I think, you want to try and move the case. I believe the process to get it moved includes contacting the country you want to move it to, and then contacting the NVC but I am a little fuzzy on the details


3. What happens if the I-129F petition approval expires during this process ? I understand the petition is good for 4 months, but even the process alone could extend past the timeframe the petition is good for.

I'm sure I'll have more questions, but this is my starting point.

1. Stuff gets emailed to you and maybe also her. Keep track of your emails.

 

2. Email or call NVC. Or wait for the case to reach Poland before trying to transfer from Poland to somewhere else. Costa Rica may not be accepting transfers - my fiance has Armenian residency and a transfer was denied due to lack of resources. Other posters do not have residency in places they live (Georgia, Serbia, etc) and are unlikely to get transfers whatsoever.

 

3. Ask the embassy to extend, list your reasons. Usually they allow extensions but it's their discretion.

Unless your fiancé(e) actually has legal residency there, it will probably be impossible to move your case to Costa Rica.

All mail goes to the petitioner. Back when my wife's was processed and when Moscow was still processing K-1s, all communication with my wife (my fiancée then) was electronic; the only thing ever actually physically sent to her was her passport with her visa in it (and presumably if you're interviewing in a country you don't live in, there wouldn't even be that as you'd pick it up in-person, I think).

It's been a while since I was paying a lot of attention to this stuff, but it should be automatically renewed in most cases when there was no possible way you could have interviewed before the expiration. Still, confirm this with whichever embassy/consulate is handling your case.

Timeline

The consulates can renew the validity of I-129F petitions in 4-month increments for up to a year.

They often do this automatically.

However, it's best to e-mail your consulate to request this extension.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
