I should add that USCIS adjudicators have a very broad discretion when issuing fee waivers, and the documents on the USCIS are only guidelines. There have been cases where fee waivers have been approved for marriage based petitions, but getting them is extremely difficult.

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Indeed, nor will you get a fee waiver! You basically have to be destitute to get one, I'm talking: Bankrupt, on SSI, with severe hardship if you can't get your spouse a green card. Fee waivers are for those in dire need, not those who will "feel the pinch".

To the OP the cost of bringing you to the US and the continued cost involved should have been things that you spouse should have taken into consideration whe you both decided to file for K1.... unless there have been a mega change in your circumstances you would be unlikely to get a fee wavier...

When hurricane Katrina happened there were people who were doing AOS who lost everything.... and yes some were given fee waviers... some were not.... so unless you feel that the fee increase is going to make you totaly destitute I dont think you would get any help with the fees.... just take a little longer to get the money together... then file...

I applied for the waiver and got denied. In my opinion, we were poor and unable to pay the fee. I sent them a ton of paperwork - collection letters, bank statements, bills, court orders for child support, etc. Back then we rarely had more than $300 in our bank account at any given time, yet our fee waiver was denied. I thought it was because we had a joint sponsor, but the USCIS policy says the fact that you have one doesn't make you ineligible for a waiver, because the joint sponsor is not responsible for the application fee. I guess, USCIS thought we were doing well and could, after all, pay the fee :wacko:
