What a mess! And Jim is either obtuse or not familiar with children born out of wedlock to USC.

 

18yo boy called when he was 17 - was obvious that his father married his mother when his divorce had not gone through.


Not sure why Jim did not steer him to try to get expedited CRBA or US passport as child of USC while under 18.

 

And also why does Jim not advise them to at least file I130s for the sons while they are under 21.

 

Now I am hooked on the show and feeling annoyed at Jim!

I think the situation is not very simple for that young man. Ultimately, I think father wants to petition for mother too. Jim was simply being a laywer, trying not to give quick advice with big consequences.

 

It's likely filing for passport also would have raised more questions about father and his marriages and there wouldn't be guarantee of quick successful resolution.

Yeah.  But the wiser course would be to just have a son sponsor mom.  
 

And in the meantime, dad marries mom.

 

And Sudanese law is relevant.  Children  of polygamous marriages in Sudan are legitimate.  Something worth looking into.

Same as 420 issue in US immigration. Just because marijuana is legal in a particular state doesn't mean it's not a problem for somebody trying to get an immigration benefit.

I got lost listening to him since he first came on board some episodes ago. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

OK had a look and of course he was wrong.

 

I think the discussion got off on the wrong foot because the caller could not accept his Mother was not married to his Father. I got the impression that there is a lot more to the story, Father seemed missing. His unwillingness to send in documents to the Consulate.

 

Actually there was a worse one, the GC Holder working for the UN.

 

A long time ago I suggested a thread detailing Jim's mistakes, well I would use another word, but it is fun.

 

I have seens a few other YT Lawyers and they all have issues.
