Seeking Advice for My Unique U.S. Immigration Situation - No Joint-Sponsor for Form I-864

I was born in the USA but moved to Pakistan at the age of 7 and later to Canada after getting married. Throughout my life, I've never worked and therefore never filed U.S. income taxes. Now, as a U.S. citizen, I'm sponsoring my husband for a family-based immigrant visa. How can I strengthen my case, considering my unique situation, especially when I don't have a Joint-sponsor for Form I-864? Any advice or experiences from similar situations would be greatly appreciated.

For the reasons you have listed, among others, it is not uncommon for the American citizen to move back to the US before their spouse.

Unless you return to the US before the interview and have stable employment that meets the I 864 requirements, you will need a joint sponsor. Montreal almost always requires the petitioner to already be domicile in the US  at the time of the beneficiary interview so best prepare for that scenario.

You were advised in your previous posts over the past few years that in your situation and considering the consulate you are going through, establishing domicile in the US is very important. Did you do research on domicile and what you need to do regarding this? It is more than providing a relative's address; you need to show that you plan to live in the US. There are many ways to do this, but the best way is for you to move to the US now, find a place to live, find a job, get the children enrolled in school, etc. 

 

Not having a joint sponsor only makes it even more important that you move to the US and start working; your spouse will not get a visa if you can't show that you are able to financially support him. If this is not possible for you, it might be better for your spouse to look into employment-based visa options.

All good answers above, but they assume you and your husband cannot qualify based on assets alone.  Take the income requirement for your household size and multiply by 3.  That is the minimum amount of liquid assets you'll need to qualify based on assets alone.  

 

Note that you MUST "qualify" in some way or have a joint sponsor, or there will be no progress towards even a visa interview.
