There is a divorce certificate from marriage 1 of course, the court clerk just cant find it (called about a half dozen times, and 2 or 3 different court clerks so far)

Are you 100% sure you are calling the correct court from where the divorce took place? If your memory is fuzzy on the year, it might be worth trying to double-check that you are remembering the correct county/location of divorce.

If the location isn't in question, I still recommend going to the clerk's office in person. With no specific date (or even the exact year) to go on, any miscommunication/misunderstanding will add to the difficulty for the clerk to locate the correct case/file.

Agreed, death certificate is the last resort.

Why "could" or "last resort"? USCIS just cares that the visa beneficiary is no longer married and hence able to marry the petitioner. In form 129-F, the instructions clearly say to provide a divorce decree OR death certificate. If the first (or any) ex-spouse is deceased, then clearly the beneficiary is legally able to re-marry. I am also assuming in this case there is a divorce decree available for the second marriage.

I am hoping, yes, we were divorced in Fishers Indiana (Hamilton county) which is a suburb of Indianapolis (Marion county) and I have spoke with several people at both, as well as Las Vegas (Where the original marriage certificate was issued. They sent me back to Indiana...

Many times if this was long enough ago they didn't digitalize the old records they will have to dig for it. Most of the time they don't want to dig so they tell you they don't have a record. You are really needing to get then to dig for it.

Next is you are not someone in the position to request your ex's death certificate. That is only for direct family, and you were no longer that when she passed.
