Cr1 or Adjustment of status?

Good morning,

I have a question to ask. This is my situation. I got married through the phone with a reverend in the US with my husband last May, this because my husband is an inmate and He will get out this year. So I have marriage certificate but I never enter the US to marry him?. He is US citizen and I am italian. So other that application for CR1 visa ..if I enter on Esta for visiting and we say I change my mind, can I file Adjustment of Status on day 91?

No.  You cannot enter the US as a visitor with the intent to stay and adjust status.  That is visa fraud.  A CR-1 is your route to immigrate through marriage.  Be aware that the US citizen cannot start the process until after you have actually met in person.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
