Form I-129F Criminal History (4A/4B)

Good evening,

 

I (the petitioner) have had a few encounters with law enforcement in my younger days for low level cannabis or civil-disobedience related activities in DC and MD. I'm afraid I can't recall or produce documentation for every encounter.

 

How do you recommend I go about collecting all of the necessary documentation needed to adequately complete question 4B on the 129F form?

 

Am I suppose to go to a courthouse in MD and DC to request copies of all my arrest records and dispositions?

Or go to get a criminal background check completed like I've done for previous jobs?

Or make a FIOA request?

Or something else...

If they are very old then they might even be on microfiche and take a couple of days to get.

 

It would be easiest to just order them by mail.  If you go to their webpage they should have a records department page and provide instructions on how to order certified copies.   I would recommend that you just call them and ask for instructions and costs for ordering them, and exactly what office to mail them to. You can enclose a pre-paid priority mail return envelope for faster return mailing.  

 

And what is critical to get is the "disposition" of the case. They want to make sure the case is not pending or that you are not a wanted criminal with arrest warrants out there.

 

You can also order a copy of your FBI record to see your arrests

You will want to make sure you give them absolutely EVERYTHING.  Even if the actual crimes/arrests/infractions are not enough to impact the case, failing to provide documentation could cause a denial.  We have seen that happen here on VJ.

Thank you, this was very helpful. A request by mail definitely sounds like the way to go. I might get the FBI records as well in case I'm forgetting anything beyond DC/MD.

Yeah, that's the goal. I'm not particularly worried about the many encounters since the vast majority were dropped and the worst consequence being a little community service. Just want to make sure I've got everything accounted for to save some time and my honesty not doubted. Thanks for your response
