Also suggest that your friend/co-worker start their own free account here on VJ as I expect there will be more questions, and it is always more difficult funneling those questions through a 3rd party.

After the marriage certificate is in hand, next step is to file an adjustment of status package ASAP.  Once those forms are filed, she will be in a period of authorized stay--not able to work or leave the country, but at least will be okay if she is asked to show evidence of her status in the US.  Until the adjustment of status package (lots of forms and documents) is filed and received, she is at risk of detainment/deportation (rarely but it has happened).  Maybe adjustment of status is what you were remembering, it is a lot more complicated than a simple marriage.

I see that you are in Florida, and for the sake of this post I will assume your fiend is as well. They should look into what the requirements are for a license in THEIR county. Some jurisdictions may require proof of legal status. If this is the case, they should look for a "blue" county either in their state or another state which is more friendly.

I have yet to come across anywhere requiring proof of legal status.

 

I am intrigued about all the paperwork involved in getting married as I have not come across that either.

@Haltech007, i downloaded florida marriage license apps from a couple of different counties - you don’t need a an SSN.

 

Valid Taiwanese passport will do.

Seems very straightforward in Florida.  One pager.  Can use in any county.

I know of at least 2 towns in NY where clerks were asking to see visa stamps (this was back in 2017). Whether it was legal or not, I cannot say.

My experience in Texas was that they county clerk just asked to see an ID, I gave my driver license and my spouse showed his passport, there was no questions whatsoever about status in the US.  We received the marriage license and 72 hours later were married and started the process of getting a green card.

There isn't a ton of paperwork to get married. You simply go get a marriage license and get married, afterwards you receive your marriage certificate as proof that you're married. All of us who came on a K-1 went through the exact same process - used our foreign passports to get the license as we had no US govt. issued IDs at the time, naturally. 

In CA you can apply for the marriage license online, takes a minute - I assume a lot of other places in this country have it online too. Then both parties go in person to pick it up. Then they get married and receive the certificate. No idea why you feel that you had to do a ton of paperwork to get married, there isn't a ton of paperwork at all.

I'll also add my two cents: All else fails, state gives them the runaround in marrying them, marrying online in Utah is always an option, only concern there is meeting in person following the marriage but well, they presumably live together or close by so it won't be a problem unlike for people trying to turn a K-1 into a CR-1.

Contradictions without citations only make you look dumb.

Just in case the clerk is some busybody who has a relative in ICE.

Given I-130 / I-485 requires a marriage certificate, it would be difficult to show an I-485 receipt to a busybody county clerk.

 

The a answer is to get married in a county that does not require both parties to the marriage to have authorized presence. This includes an online marriage “in”  Utah county which does not require leaving ones state of residence.

Non issue. Undocumented people get married all the time. 

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived
